Page 2 <br />1.26.76 <br />Mr. Briggs asked for the position of the Board on waiving the require- NOTICES TO <br />ment for personal notification to landowners deemed affected by "W" LAND OWNERS <br />zoning Articles for the 1976 A.T.M. Sections 10 and 11 of Ch.808, & ABUTTORS "W" <br />ZoningEnabling Act, and subsection 14.2 of the Zoning By-law were HEARINGS <br />referred to. Upon a motion duly made and seconded, it was VOTED; <br />Because of wide application in the Town, mailing of copies of legal <br />notification of the Public Hearings to be held on February 18 and <br />19, 1976, on proposed "W" zoning Articles to land owners affected <br />thereby is not deemed necessary. <br />Owners of Green & [,shite land will be notified by Certified Mail and <br />legal notices will be published in the Lexington Minute -man as required. <br />Letter from Town Engineer Chase, stating amount of $150,000 necessary LOWELL EST.II <br />for surety on Lowell Estates II subdivision, was noted. Upon a motion BOND <br />duly made and seconded, it was voted to authorize the planning director <br />to inform the developer, Louis Stoico, that security of $150,000 will <br />be necessary to ensure completion of work in Lowell Estates II. <br />Mr. Briggs reported on his conversation with Mr. Brooks, U.S. Postal INCOMING MAIL <br />Service, and his assurance that no attempts at land acquisition for an DEPOT <br />incoming mail depot are being made at this time. <br />' At 8:35 p.m., Norman Cohen joined the meeting for discussion concern- BATTLEVIEW PK. <br />ing suit by developers of proposed Battleview Park subdivision, and COURT CASE <br />summons served to Planning Board members. Mr. Cohen explained the basis <br />of the suit, and informed the members that no appearance by them is <br />necessary. <br />Letter from the Board of Selectmen to Grey Nuns, indicating lack of GREY NUNS <br />interest of the Town in purchasing of properties on Pelham Rd., was PELHAM RD. <br />noted. <br />Preparation of reports to Town Meeting on Planning Board Articles was PLANNING BD. <br />considered. Members agreed to draft reports as follows: REPORTS,ARTI- <br />Mr. MacKenzie: Numberingcdrrection ArticlEs & "Bldg. Comm."Article CLES <br />Mr. Brown: SPS Planting Article <br />Dr. Clarke: Condominium Regulations and Article allowing the Town to <br />repair unaccepted ways. <br />Preparation of report on Wetland Articles was tabled pending Public <br />Hearings on the Articles. <br />Mr. Briggs reported on rezoning proposal for land at Winter St. to WINTER ST. <br />allow construction of a restaurant. The proponent, Mr. Burditt, will REZONING ART. <br />present his proposal to the Board on Feb.23, and the Public Hearing <br />will take place on February 26. <br />The meeting adjourned at 8:59 p.m. ail <br />Albert P.
