PLANNING BOARD MEETING <br />September 16, 1974 <br />' The meeting of the Lexington Planning Board was called to order at 7:30 p.m. <br />by the Chairman Dr. Clarke with members Costello, L. Brown, S. Brown, <br />MacKenzie, planning director Briggs, and secretary Mrs. Snow present. Also <br />in attendance was John Frey, D.A.C. <br />The minutes of Planning Board meeting of August 26, 1974, were approved <br />as corrected. MINUTES 8/26 <br />The request for bond release from developer Busa on the Columbus St. sub- <br />division was considered. Mr. Briggs reported on his conference with <br />Community Nursery School officials, and their satisfaction with correc- BOND RELEASE <br />tive work at the hammerhead turning area to ensure safety of the pupils.COLUMBUS ST. <br />All neighbors consulted are apparently satisfied with conditions. Upon SUBDIVISION <br />a Motion duly made and seconded, it was VOTED: <br />That the bank passbook in the amount of $5,000 to ensure completion <br />of construction in the Columbus St. subdivision be released, as <br />recommended by James E. Chase, P.E., Town Engineer. <br />A plan submitted by Frederick Conroy, Esq. for Michael Colangelo, with FORM A74-23 <br />Application Form A74-23, showing increased area in the Kitchen & Kutch- HARTWELL AVE. <br />in parcel at Hartwell Ave. and Hinchey Rd. was reviewed. Upon a motion COLANGELO <br />duly made and seconded, it was VOTED: <br />The plan entitled "Plan of Land in Lexington, Mass.", dated Sept. 11, <br />1974, by Miller & Nylander, submitted on Sept. 13, 1974, by Frederick <br />Conroy, Esq. for Michael L. Colangelo, with Application Form A74-23, <br />showing Lot 3 at Hartwell Avenue and Hinchey Road requires no approval <br />under the Subdivision Control Law. <br />The plan was so endorsed by members of the Board. <br />Legal procedures to ensure Planning Board involvement and opportunity to ST.BRIGID'S <br />state the view of the majority of the Board in the event the decision of HOUSING <br />the Housing Appeals Court on the St. Brigid's housing proposal is <br />appealsed by the Lexington B/A, were discussed. A motion was made by HAC DECISION <br />Mr. MacKenzie and seconded by Mrs. Brown, as follows: <br />That the Planning Board notify the Board of Selectmen that in the event <br />of an appeal to the Superior Court by the Board of Appeals in the <br />St. Brigid's case, the Planning Board will intervene as a party and <br />hereby requests the Board of Selectmen to provide legal counsel for <br />the Planning Board. <br />Mr. Costello moved that the motion be amended as follows: <br />That in the opinion of the Planning Board, the Board of Appeals should <br />not be denied legal counsel, in the event of an appeal. <br />The motion to amend was not seconded. <br />The motion as presented by Mr. MacKenzie was voted by a majority of the <br />Board. <br />' The Selectmen are to be informed of the intention and request later in <br />the evening. <br />
