The Planning Board waives the requirement for installation <br />of sidewalks as stated in Section 7.3.5 of the Rules and <br />Regulations Governing the Subdivision of Land in Lexington, <br />Massa <br />4. Since municipal sewer is not accessible and will not be <br />available for at least two years, the Planning Board waives <br />the requirement for construction of sanitary sewers, accord- <br />ing to Section 7.6. of the Subdivision Regulations. <br />5. No building or structure shall be permitted on Lot 11 without <br />prior consent of the Board of Health. <br />6. The name of the street shall be Pitcairn Place. <br />The Board reviewed the Covenant for Minute Man Ridge ssbiow uion., <br />as prepared by Town Counsel. Upon a motion duly made and seconded, <br />it was voted that the covenant be accepted, and was so endorsed by <br />the members. <br />Amount of surety to ensure completion of work was considered. It <br />was voted that the amount be established at $41,OOO,as recommended <br />by the Town Engineer in his letter of April 4, 1974. <br />Request for release of Lots 8, 9, 10 and 12 were considered. Upon <br />a motion duly made and seconded, it was voted that Lots 8, 9, 10 <br />and 12 be released from covenant, subject to provisions of the <br />Certificate of Action and upon deposit with the Town Treasurer of <br />security in the amount of $41,000. <br />Petition of Martin Bernard, Burlington Arcade, for variances <br />regarding land use and earth removal at the Burlington line <br />(B/A hearing June 18), was discussed. Mr. MacKenzie agreed to <br />draft a letter of Planning Board recommendations, based on the <br />discussion, indicating opposition to the granting of the variances. <br />Memorandum from the Town Engineer, dated May 24, 1974, commenting <br />on his site review of proposed Farmhurst, Section 5 subdivision, <br />was reviewed. Letter from Kenneth A. Lucas, Board of Health <br />consultant, dated March 30, 1974, was noted. The Planning <br />Director was instructed to inform Mr. Hamilton, developer, of <br />requirements listed by the Engineering Dept. to ascertain that <br />the runoff from proposed development will have no detrimental <br />effect on areas downstream and that Town drainage system will be <br />sufficient. <br />Mr. Briggs reported on his site review of proposed Bicentennial <br />Estates at Cary Ave., regarding the developer's premature ex- <br />cavation of peat. Location of a drainage ditch and general <br />conditions on the site were discussed.
