At a meeting of the County Commissioners for the County of Middlesex,
holden at Cambridge within and for said County,
on the first Tuesday of June, in the year
of our Lord one thousand eight hundred ninety-seven,
The Selectmen of Bedford
in said County by their petition to said Commissioners - among other matters - pray
that a road be laid out from the terminus of a road
recently built in Bedford and Lexington, to a point on the
Main Road from Bedford to Lexington near the estate of Patrick
Ryan.
as will more fully appear, reference being had to the petition filed of record in the case.
The petition was presented to the County Commissioners, at their meeting holden at
Cambridge, within and for said County, on the first Tuesday of January
A.D. 1897, when and where said Commissioners caused notice to
be given to all persons and corporations interested therein of the
time and place when and where they would meet for the purpose
of viewing the premises and hearing the parties, as by their order of
notice on file and of record will more fully appear. In pursuance
with said order of notice said Commissioners met and heard the
parties and viewed the premises, and at an adjourned meeting said
location was adjudged of common convenience and necessity.
And now the said Commissioners make return of their proceedings in the premises,
as follows: The County Commissioners for said County, having given notice as the law
directs, met at the Town Hall in Bedford
in said County, on the nineteenth day of May in the year
eighteen hundred ninety-seven, when and where the parties appeared, to wit,
the petitioner by Irving L. Hodgdon of the board of Selectmen
of said Bedford
and no person appeared to object.
And the premises having been examined, and all parites fully heard said Commissioners
proceeded to lay out said road as prayed for in said
petition, and the following description is a true description of said road as
hereby laid out and ordered.
The northerly line beginning at a stone bound at the Railroad location fence on
the westerly side of the Middlesex Central Railroad Branch of the Boston and Lowell
Railroad, said bound being at the terminus of the northerly line of a new road laid
out by said County Commissioners by return dated November fifth 1892, thence from
said bound South 83° 1' 30" East, one hundred one and eight tenths (101.8) feet to a
stone bound, thence on a curve of three hundred forty-four and five tenths (344.5)
feet radius, bearing to the left two hundred eighty-two and ninety-five hundredths
(282.95) feet to a stone bound, thence North 49° 55; East two hundred
seventy-one and thirty-five hundredths (271.35) feet to a stone bound, thence on
a curve of four hundred seventy-six and thirty-eight hundredths (476.38) feet
radius bearing to the right two hundred seven and seventy-two hundredths
(207.72) feet to a stone bound, thence North 74° 54' East, five hundred and forty-eight
hundredths (500.48) feet to a stone bound, thence bearing to the left with a curve
of seven hundred sixteen and nine hundredths (716.09) feet radius bearing to the
left one hundred twenty-three and twenty-five hundredths (123.25) feet to a stone bound
thence on a curve of five hundred seventy-five and four hundredths (570.04) feet
radius bearing to the right three hundred forty-five and forty-two hundredths
(345.42) feet to a stone bound, thence South 86° 22' East two hundred nine and forty-
two hundredths (209.42) feet to a stone bound, thence on a curve of five hundred
ninety-five and sixty-nine hunderedths (595.69) feet radius bearing to the left,
one hundred ninety-four and ninety-four hundredths (194.94) feet to a stone
bound, thence North 74° 53' East two hundred fifty-four and five tenths
(254.5) feet to a stone bound at the westerly line of Bedford street.
The southerly line is parallel to the above described northerly line and
fifty (50) feet to a stone bound at the westerly line of
Bedford street with a curve of seventy and five tenths (70.5) feet radius.
The above courses are reckoned from the magnetic meridian and the
description is intended to conform to a plan of said street signed by
F. H. Kendall engineer, and dated 1897, on which the above described
lines are shown in red.
of the same to the width aforesaid; and so shaped that the centre shall be eight
inches higher than the sides by a circular, curved surface; all small inequalities shall be
reduced to a level, or a regularly inclined plane, and greater rises and hills, to an angle
not exceeding three degrees with the horizon; drains, sluices, and bridges properly con-
structed of stone [struck], and of sufficient capacity, shall be made at all places necessary for
conducting away the water; swampy and soft bottoms shall be raised at least three
feet; and six inches on the surface of the whole part, to be travelled upon shall
consist of gravel or other material which shall give a good wearing surface; and permanent
stone monuments shall be placed at each end, and at each angle, in said described line.
Where excavations are necessary, the banks on the sides shall not make a greater
angle than 33 degrees with the horizon; railings shall be erected at all
steep and dangerous places; and all walls and fences removed from within the new lines of street;
and the whole shall be done in a workmanlike manner, to the acceptance of saidCommissioners.
And the proprietors or occupants of the land, over which said high way is thus
laid out, are allowed until the first day of [blank] next to remove therefrom
any wood, timber or trees. And said Commissioners having heard the proprietors
of said land by themselves or their agents, on the subject of damages by them sustained
by reason of laying out said high way, have estimated the same as follows, to wit:-
that no damages are sustained and none are awarded.
And the said Commisioners further order and determine that the sum of Thirty-three and
one third per cent of the costs (33 1/3%) is a fair and just proportion of the expenses
of said alterations to be paid by the County; and said sum shall be paid out of the County
Treasury into the Town Treasury of Lexington whenever the Selectmen of
said town shall present a certificate certifying the costs of said alteration and construction and that all claims by reason of said alterations
have been settled and said street shall be completed to the acceptance of said Commissioners.
And the said Commissioners further determine and order that the said town
of Lexington shall pay all damages, costs and expenses (if any) not included
in the above award, that any party may by legal process obtain in consequence of said
location and construction throughout the whole of said
high way, as hereby widened, straightened, altered and established.
And the said Commissioners further order, that the high way described in said
return be, and the same is hereby established, as and for a public high way, and that
the same be recorded to the end that the same may hereafter be known as such.
IN WITNESS WHEREOF, WE, the said County Commissioners, have hereunto set our hands
this twenty-fourth day of August in the year of our
Lord one thousand eight hundred and ninety-seven
