Chapter 44, Section 7, or any other enabling authority. Chief Corr will provide his comments regarding the 2018 Annual Town Meeting Warrant Article 34 - Make Lexington a"Welcoming, Inclusive, Safe Community" SUGGESTED MOTION: FOLLOW-UP: DATE AND APPROXIMATE TIME ON AGENDA: 3/26/2018 6:35 p.m. ATTACHMENTS: Description Type Arrtk ka 34I...Matron Rackup Matorrkat ❑ C:h Verr monnu> Town of Lexington Motion 2018 Annual Town Meeting ARTICLE 34 TO MAKE LEXINGTON A "WELCOMING, INCLUSIVE, SAFE COMMUNITY" Proposed Resolution to Make Lexington a "Welcoming, Inclusive and Safe Community" MOTION: Resolved, that the Town is committed to making Lexington a truly"Welcoming, Inclusive and Safe Community". To this end, be it further resolved that the Town of Lexington hereby announces its support for the Safe Communities Act(SCA, S.1305 & H.3269), currently before our legislature. In support of this resolution Town Meeting requests that the Town take the following actions as soon as practical: 1. Update the Police Policy and Procedures Manual so that it is fully compliant and fully aligned with the SCA, as summarized in item 6 below. 2. Train all police department employees, with respect to these changes in the Police Policy and Procedures Manual. 3. Inform the community through public communications, municipal signage and other means deemed appropriate, that the town is a Welcoming, Inclusive and Safe Community. 4. Provide quarterly reports by the Lexington Police Department to the Board of Selectmen on all contacts in aggregate, and the nature of those contacts, with ICE or other federal immigration authorities. 5. Report any subsequent changes to the Police Policy and Procedures Manual related to this resolution in a Public Hearing. 6. Refer to, and consider including to the extent consistent with applicable laws, these key SCA points, when updating the Police Policy and Procedures Manual: A. Ensure Equal Treatment Under the Law No Town of Lexington employee will inquire about the immigration status of any individual, except as part of the process of U Visa process (see "G" below), or unless such information is required by law, and the individual's status, if known, will not affect his or her treatment in any way. B. No Facilitation Without a Criminal Judicial Warrant Town of Lexington employees will not take any actions on the basis of Immigration and Customs Enforcement(ICE), ICE Detainers, ICE Administrative warrants or informal requests of any type. However, Lexington Police will respond to criminal judicial warrants as required by law. C. No Deputizing of Local Officials for Immigration Actions No officer or employee of any Town of Lexington Law Enforcement agency shall perform the functions of an immigration officer, whether pursuant to 8 U.S.C. section 1357(g) or any other law, regulation, or policy, whether formal or informal. ICE notification requests No Town of Lexington employee will respond to ICE Notification Requests with any information or action that could facilitate an individual's apprehension by ICE. D. No Release of Records, Information or Access to Facilities Without a Criminal Judicial Warrant No Town of Lexington employee will provide any information about individuals or organizations to ICE agents or provide or facilitate access to individuals by ICE agents, related to persons or organizations of interest to ICE, without a criminal judicial warrant based on probable cause, unless it is required by law. E. Individuals Subject to ICE interventions If Town of Lexington employees obtain an ICE request or any documentation pertaining to an individual with whom they have contact,the Town of Lexington employee will promptly share that information with the individual. An interview between a US Department of Homeland Security Agent for immigration enforcement purposes and a person in custody of the Lexington Police Department(LPD) shall take place only if the person has given written consent. The written multilingual consent form shall be provided by LPD, and must explain the purpose of the interview, that it is voluntary, that the person may decline to be interviewed, and that they may refuse to be interviewed until their attorney is present. If the person requests a lawyer, LPD shall facilitate the presence of an attorney, but need not pay fees. If the person declines the interview, the LPD shall not allow DHS to conduct the interview. A translator should be offered, free of charge, to the individual if the individual cannot read the consent form or would like a translator for the interview. F. U Visa Verification Town of Lexington employees will consider and sign a U Visa Certification request when doing so supports the US Victims of Trafficking and Violence Prevention Act. G. No Participation in Raids and Other Immigration Enforcement Actions No Town of Lexington employee may participate in an operation or use of Town of Lexington funds, resources, facilities, property, equipment, or personnel to assist in the enforcement of federal immigration law. H. Compliance with Federal Law. Nothing in this Section shall be construed to violate any valid federal law, or to prohibit any town agency or department from providing another law enforcement agency citizenship or information status, consistent with 8 U.S.C. § 1373. I. Compliance with State Law. Nothing in this section shall be construed to violate any state law. (03/22/2018) Review of Warrant Article 34 Proposed Resolution to Make Lexington a Welcoming, Inclusive and Safe Community Presented to the Board of Selectmen March 26, 2018 Mark Corr® Chief of Police I deeply appreciate the emotional and moral dilemma that residents feel that deporting non- criminal undocumented residents is wrong. It is important for the Town of Lexington® other communities and residents to have a strong voice with our State and Federal elected officials in this regard. I have reservations® however® with adopting the Article 34 Resolution as currently drafted as® in my opinion® it has the potential to endanger public safety and does not appear to accurately reflect the current version of the proposed Safe Communities Act, Based on the most recent version of the Resolution provided to staff® I have the following comments; Item 1 The Resolution asks the Town to change the Police policies "so that it is compliant and fully aligned with the Safe Communities Act (SCA)® as summarize in item 6below." Item 6® however® appears to be significantly different than the Safe Communities Act (SCA), I on®t believe the Lexington Police Department (L D) would e "fully aligned" with SCA if we use the language in the Resolution, Item 4 Reporting to the 6®S quarterly. The SCA requires reporting to the Attorney General and I suspect® when this Act is formalized, there will be an electronic method of doing so. Holding aside that the L D rarely has ICE contacts® we would prefer not to have a duel reporting requirement. Item 5 It is not clear who the L D would report to, The Town Manager is the legal authority for Police Department policy (Town Counsel is reviewing this). If the SCA passes® the L D reports submitted to the Attorney General will likely be public documents. It is not clear what purpose a public hearing serves as this reporting document is factual information while public hearings are for the purpose of soliciting public comments. Item 6 1 have a variety of concerns with this section. First® I on®t believe aspects of sections A-J accurately interpret the SCA. Secondly, SCA may change between Town Meeting and the final version approved by the Legislature. If this Resolution is approved, how will this relate to the final version of the SCA? Item 6A I believe the Resolution deletes important clarifying text from the SCA. The current SCA version says® "No law enforcement agency shall inquire about a person®s immigration status® unless such information is required y law® or Is an element in a crime o Ic the law enforcementagency Is investigating person. e sis added ". The Resolution deletes this second portion of the statement and substitutes other language. Item 6B "Town of Lexington employees will not take any actions on the basis of Immigration and Customs Enforcement (ICE)® This essentially prevents the L D from working with ICE for law enforcement including Customs officials, The Massachusetts Immigrant and Refugee Advocacy Coalition cites the importance of SCA. They believe that; "The bill (SCA) would not stop police from doing their everyday work® arresting people in the course of a criminal investigation® or even working together with federal agencies to fight crime. It only limits their otherwise voluntary collaboration with immigration enforcement. This is a question of civil federal law." The Resolution®s interpretation of SCA seems to prevent the L D from doing "everyday" work such as the important work being one by Officers helping to stop human trafficking. In the past® Lexington has had home invasions® armed robberies and major credit card fraud committed y undocumented persons, The L D needs to work in collaboration with federal agencies on criminal matters. Item 6 C The SCA makes no mention of"Deputizing" a local official. Inserting a term not used by SCA is problematic and may give an entirely different meaning. Item 6D The Town will not respond to ICE with "any information or action that could facilitate an in ivi ual®s apprehension by ICE." What if the person is being investigated for being a violent criminal? Item 6F If a Town employee receives a request from ICE® the "Town of Lexington employee will promptly share that information with the individual." The L D finds this very troubling, The SCA says® "if any person is subject to a civil immigration detainer request or an administrative warrant® the law enforcement agency_ vi c so a eso (em2hasis addedl shall provide the person with a copy of the civil immigration detainer request or administrative warrant® and any other documentation........ The Resolution has significantly changed the meaning of this section. Furthermore® the Federal District Attorney for Boston has expressed to law enforcement agencies his concern that that ICE agents an the individuals they seek are experiencing more injuries as a result of confrontations in the field. The L D believes it is unacceptable for a Town employee to contact a person and notify them that ICE wants them, We could e directly contributing to someone getting injured or worse® particularly if the person wanted is a violent criminal, Item 6H The SCA does not mention "Participation in Raids". It only references not using funds, resources® facilities,,,, to enforce federal immigration law. The Lexington Police Department does not want any raid to occur in Lexington without its knowledge and wants the option to participate in a raid to make sure that the interests of Lexington are protected.
