HomeMy WebLinkAbout1978-03-09BOARD OF APPEALS March 9, 1978 The Board of Appeals held a regular meeting on Thursday, March 9, 1978, begin- ning at 7:30 p.m., in the Town Office Building, Selectmen's Meeting Room. Present: George P. Wadsworth, Chairman Ruth Morey Woodruff M. Brodhead Irving H. Mabee Thomas G. Taylor Public hearings were held on the following petitions, notices,of hearings hav- int been mailed and advertised as required by statute. Norman L. Paul, M.D. - renewal of special permit granted under Section 25.81 to continue to use a part of his residence at 26 Barberry Road as a part-time office for the practice of medicine. Harold R. Millican and Helen M. Millican - renewal of special pern4t granted under Section 25.21 and also pursuant to Section 12.2, to continue to operate a private school for the instruction and study of swimming, in the private swimming pool enclosure in the rear of their property at 90 Hancock Street. Lexington Gardens, Inc. - special permit to construct two 28 feet by 96 feet alum- inum greenhouses, in accordance with Section 25.31. These greenhouses will replace approximately 6,000 sq. ft. of hotbeds and be used for growing plants, vegetables and bushes during the entire year. SMM Realty Corp., c/o Spaulding and Slye Corp. for special permits and variances for its property at 1-5 Forbes Road as follows: (1) Special Permit after finding and determination pursuant to Section 13 that the buildings, parking areas, drives and other improvements (shown on a site plan) will constitute a suitable development and will not result in a substantial detriment to the neighborhood. (2) Special Permit pursuant to Section 12.2 to allow the construction of the build- ings for uses set forth in Sections 25.40, 25.41, 25.42 and 25.71 of the Use Regulation Schedule. (3) Variances pursuant to Section 12.3 to allow: (a) construction of buildings A and B as shown on plans, which buildings have front yards of less than 100' abutting Forbes Road (75' in the case of Build- ing A and 62' for Building B from Forbes Rd.), and in the case of Building B a rear yard of less than 100' abutting an RO district (closest point of Build- ing B is 67' from RO district), which conditions vary from Section 27, Schedule of Dimensional Controls; and (b) the design of parking spaces having a 9' width and 18' length in variance length in variance with the definition of parking space in Part 4. Decisions: The Board made the following decisions, all in open meeting. See decisions filed with the Town Clerk for more details. Paul - granted,unanimously, for 5 years with certain limitations. March 9, 1978 da Millican - granted unanimously for 5 years, subject to certian con4itions. Lexington Gardens - denied, 4 to 1, George P. Wadsworth voting in flavor, all others in opposition. SMM - decision to grant, but this decision will be deferred until donditions are included in a permit which will be acceptable to all board members%fitting" for this hearing.
