HomeMy WebLinkAbout1977-12-13BOARD OF APPEALS December 13, 1977 ' The Board of Appeals met at 7:20 p.m. on Tuesday, December 13, 1977, in the Selectmen's Meeting Room, Town Office Building. Present: George P. Wadsworth, Chairman Ruth Morey, Vice Chairman Woodruff M. Brodhead Thomas G. Taylor Irving H. Mabee William J. Scouler, Associate Natalie H. Riffin, Associate A photograph was taken for the Annual Town Report. Public hearings were held on the following petitions, notices of the hearings having been mailed and hearings advertised in the Lexington Minute -Man newspaper as required by statute. Sitting for these hearings were: Mr. Wadsworth, Mrs. Morey, Mr. Brodhead, Mr. Taylor and Mr. Scouler. Others left the meeting. Moore Homes, Inc. - special permit, pursuant to Lexington sign by-laws, to erect a free standing sign at Fiske Common, 31 East Street. William F. Butterfield and Mary L. Butterfield — variance to subdivide a parcel of land located at 11 Kimball Road into two lots shown as Lots 29 and 30 on a plan entitled "Plot Plan of Land in Lexington," dated October 21, 1977, Albert A. Miller and Wilbur C. Nylander, C.E. and Surveyors, each of which would have a frontage on Kimball Road of seventy-five (75') feet and an area of 9375 square feet, and to maintain the existing dwelling on Lot 29. Petitioners' deed dated September 24, 1964, refers to "Two certain lots of land in said Lexington, being shown as Lots 29 and 30 on a Plan entitled "Land of Ernest E. MacPhee at Lexington, July, 1929, F. P. Cutter, C.E." and it appears that said plan as recorded at the Registry of Deeds, which subdivided abutting land into 75 foot lots did not properly identify Lots 29 and 30. Boston Urban Associates, Agents for Hayden Office Trust - variance under Section 12.3 Variances of the Zoning By-law, the right to vary Section 32.2 Schedule of Dimensional Restrictions for Parking and Loading. Location of Property: North- easterly side of Hayden Avenue running 706.02 in a Northeasterly direction from a point near the intersection of Hardy's Brook (so-called) and Hayden Avenue. The parcel of land contains 6.4672 acres and is shown on a certain plan entitled "An Office Complex for: Hayden Office Trust, Lexington, Massachusetts", Symes, Maini and McKee, Inc. Architects and Engineers dated October 21, 1977. The petitioner seeks to modify a variance granted to Boston Urban Associates by decision of this Board on April 21, 1977 wherein the said Boston Urban Associ- ates were permitted to locate parking for nineteen (19) cars twenty-five (25) feet distant from the Northeasterly boundary of the property rather than the fifty (50) feet adjacent to a residential district boundary; said modification is to permit parking for nineteen (19) cars ten (10) feet distant from the Northeast- erly boundary of the property rather than fifty (50) feet. The modification will ' permit the easterly parking area to be separated from Hardy's Brook by an additional thirty-five (35) feet. Total parking area will not be increased. Boston Urban Associates is a Massachusetts business trust under a declaration of trust dated July 2, 1970 and are managing agents for Hayden Office Trust, Edward H. Linde and Mortimer B. Zuckerman, Trustees, who hold legal title to said property. Board of Appeals Hearings December 13, 1977 (continued) -2 ' Jefferson Union Company, a Massachusetts Corporation having a usual place of business in Lexington, to continue the use of variances previously granted to G. Ruth and Paul J. McCormack in 1959 and 1973 to use the land and buildings now numbered 789 Massachusetts Avenue in said Lexington under the uses permitted in Sections 25.40, 25.41 and 25.42 of the Zoning By-laws. James B. Hansen et als - to rescind the granting of a building permit by the building department, issued to Lexington Gardens on.30 September 1977, for the construction of two new greenhouses. DECISIONS: The Board made the following decisions, all in open meeting. See decisions filed with the Town Clerk and in Board of Appeals' files for more details. Moore - denied unanimously. Butterfield - granted unanimously. Boston Urban - granted unanimously. Jefferson Union - granted unanimously. Hansen - withdrawn by those making appeal (building permit returned).
