F <br />BOARD OF APPEALS HEARINGS <br />March 26, 1968 <br />A regular meeting of the Board of Appeals was held on Tuesday, <br />March 26, 1968, in the Selectmen's Room, Town Office Building. Present <br />were Chairman Nickerson and members Abbott, Dawes, Sheldon and Wadsworth, <br />and the secretary, Mrs. Macomber. The following petitions were called to <br />order at 7:30 p.m.: <br />John Modoono - (Highland Farm) - for permission to continue opera- <br />tion of stand for the sale of evergreens, shrubs, various other plants, <br />and garden supplies on lot abutting 192 Woburn St., also to sell Christmas <br />trees, wreaths, etc. in the appropriate season. <br />Philip A. Fischer - to vary the Lexington Zoning By -Law in order to <br />allow the overhang of the existing building and the new proposed extension <br />at 218 East St. to have a 26 ft. set back from the street instead of the <br />required 30 ft. <br />Peter B. and Dianne N. Carberry - to vary the Lexington Zoning By -Law <br />in order to subdivide the property at 10 Cottage St. into two lots, one of <br />which would have frontage of 92 ft. and an area of 28,800 sq.ft., second <br />of which would have frontage of 5 ft. and an area of 215 sq.ft. The lot <br />comprising 215 sq.ft. would be conveyed to the abutting owners in order to <br />provide access to the rear of their property. <br />' Outhet Realty Trust - to vary the Lexington Zoning By -Law in order <br />to erect a building on lots 15 and 16 at 30 Gleason Rd. which lot does not <br />have the required area and frontage. <br />Heritage Realty Trust - for a finding and determination that the pro- <br />posed location of building, the proposed major topographical changes, if <br />any, and the planned provisions for waste disposal, surface and ground water <br />drainage, erosion control, parking areas, loading areas, maneuvering areas, <br />driveways, and the location of intersections of driveways and streets are <br />such that the proposed construction of a new building will constitute a <br />suitable development and will not result -in substantial detriment to the <br />neighborhood. Said parcel of land is located at #1 Militia Drive (at Wor- <br />then Rd, near property of First National Stores, Inc.) <br />Itek Corporation - for (1) a finding and determination that the pro- <br />posed corporate facility will constitute a suitable development; (2) variance <br />of the provision of the building by-laws, Art. X, Sec. 2 to permit floor area <br />within fire walls in excess of by-law. G <br />Robert 0. Tillinghast - to vary the Lexington Zoning By -Law under <br />Sec.8(a)l.b. in order to permit one 2 -family unit in rear of 465 and 475 <br />Massachusetts Ave. <br />' At the close of the hearings an executive session was held during <br />which the followihng decisions were reached: <br />
