BOARD OF APPEALS HEARINGS <br />September 14, 1965 <br />A regular meeting of the Lexington Board of Appeals was held in <br />the Selectmen's Room, Town Office Building, on Tuesday, September 14, <br />1965. Present were Chairman Nickerson, Members Abbbtt, Hoyt, Ripley <br />and Wadsworth. <br />At 7:30 p.m. the following hearings were declared open: <br />George and Louise MUM - to vary the Lexington Zoning By-law <br />in order to maintain building g at 34 Cottage Street in Lexington which <br />has a setback of 29.5 ft. instead of the required 30 ft. and side yards <br />of 6.9 and 5.9 ft. respectively instead of the required 7-1/2 ft. <br />Mrs. Willem MacDonald - to vary the Lexington Zoning By-law in <br />order to maintain bu-iMij-71 19 Bird Hill Rd. which has a side yard of <br />8-1/2 ft. instead of the required 10 ft. <br />Francis R. Heiligmann - to vary the Lexington Zoning By-law in <br />order to erect a wo car garage at 25 Harbell St. which would have a <br />7-1/2 ft. side yard instead of the required 10 ft. <br />Hans R. Camenzind - to vary the Lexington Zoning By-law in order <br />to cons ruc a wo car garage attached to the property located on 168 <br />North St. which will result in a side yard of 9 ft. instead of the re- <br />quired 15 ft. <br />James L. Jones - for permission to construct a lean-to greenhouse, <br />21 ft. x 9-574 N. a 45 Middle St. to be used as a conservatory. <br />The Reorganized Church of Jesus Christ of Latter Day Saints - to <br />vary the Lexington Zoning By-law in order to construct a church steeple <br />on the new church construction at 1386 MasF. Ave. which will be 70 ft., <br />or 5 ft. over the regulation height for such construction. <br />At the close of the hearings an executive session was held dur- <br />ing which the following decisions were reached: <br />George and Louise Murphy - granted <br />Mrs. Willens MacDonald - denied <br />Francis R. Heiligmann - granted <br />Hans R. Camenzind - denied <br />James L. Jones - granted <br />The Reorganized Church of Jesus Christ of Latter Day Saints - <br />during the conversation it developed that he had not included on top of <br />the steeple the cross and lightning rod so actually should have requested <br />for a variation of 12 ft. instead of 5 ft. addition. Petition was <br />granted for 77 ft., or 12 ft. over the regular height for such construc- <br />tion, it being understood that the main construction of the steeple would <br />be only 5 ft. over regular height but that the top of the cross and <br />lightning rod would extend 7 ft. above, thus making a total variation of <br />12 ft <br />
