260 <br />BOARD OF APPEALS MEETING <br />March 3rd, 1939 <br />A meeting of the Board of Appeals was held in the <br />Selectmen's Room, Town Office Building, at 8:00 P. M. <br />Messrs. Glynn, Robbins and Ferguson were present. Assoc- <br />iate Member Errol H. Locke arrived at 8:10 g. M. The <br />Secretary and the Building Inspector were also present. <br />In the absence of Chairman Maddison, Mr. Glynn acted <br />as Chairman Pro -tem. <br />At 8:00 P. M. hearing was declared open on the appli- <br />cation of the Shell Union Oil Corp, for permission to construct <br />and maintain a one car garage and--lubritorium at 1095 Mass. <br />Ave. Nine personswerepresent at the hearing. <br />The notice of the hearing was read by Clerk Robbins, <br />Mr. A. A. Burns, engineer for the Shell Union Oil Corp. <br />appeared in favor of the granting of the petition. He said <br />the corporation wished to add a one car lubritorium which <br />would be of the same architectural design as the present <br />building. The addition would be on the right side of the <br />station. He presented plans and said that the old pits would <br />be removed. If the petition were granted, all work on cars <br />would be done inside, which would be a great convenience. <br />' <br />The addition would be 12 feet by 26 feet. <br />The Chairman asked if these were the only changes to be <br />made, and Mr. Burns said that there would be new floo& lights, <br />but no new pumps. He said it was planned to move the pumps <br />nearer together so that they will not take up so much space;. <br />He said that the original sketch showed a new neon sign, but <br />the second sketch did not have it in the same place. Mr. <br />Burns said he thought the addition would be an improvement <br />to the station. The Chairman asked if they had made provi- <br />sions to keep the oil drums inside and Mr. Burns said that <br />they had and that there would be no drums around outside. <br />.No other persons wished to be heard in favor of the <br />granting of the petition. <br />Miss Jane F. Knight of 1088 Mass. Ave. asked if the <br />granting of the petition would change the zone of the ad- <br />joining property. The Chairman said that this was not a <br />change in the Zoning Law and that nothing but the Town <br />Meeting could change the Zoning Law. He said that this was <br />not a business district but was a non -conforming use. He <br />said there was a question as to how much the non-"nforming <br />use could be increased and that there was a question in <br />this case as to whether this would be a change or an <br />improvement. <br />
