BOARD OF APPEALS MEETING <br />AUGUST 16, 1932. <br />Board of Appeals meeting was held in the Conferance <br />Room, on August 16, 1932 at 8:10 P.M. Messrs. Glynn, <br />Custance and Baldrey Were present. <br />The minutes of the last meeting were read and approved. <br />The Board considered the application of Arthur R. <br />Witham for permission to use the premises at 317 Marrett <br />Road as presented at the hearing held August 9, and voted <br />not to grant a permit for the following reasons: the <br />garage is partially within a residential zone; the building <br />in question is of the type intended for accessory use; the <br />use for a repair shop for automobiles would tend to interfere <br />with the comfort of adjoining residents; and would tent to <br />injure the value of adjacent property in the residdntial <br />zone. <br />The Board of Appeals, acting under General Laws, <br />Chapter 40, sec. 27, having received a written petition <br />addressed to it by Arthur R. WIbham, a copy of which is <br />hereto annexed, held a public hearing thereon of which <br />notice was mailed to the petitioner and to the owners <br />of all prpperty deemed by the Board to be affected thereby <br />as they appear on the most recent local tax list, and also <br />advertised in the Lexington Times -Minute -Paan, <br />a newspaper published in Lexington, which hearing was <br />held in the Selectmen's Room in the Town Office Building <br />on the 9th day of August 1932 at 7:50 o'clock P.M. Messrs. <br />Custance, Baldrey and Glpm of the members -,of the Board of <br />Appeals were present at the hearing. <br />After hearing the evidence offered by the_,p�dt3.tioners <br />and such other evidence as was offered, the Board in private <br />session at a meeting held August 16, gave consideration to <br />the subject of the petition and a majority of the Board voted <br />that in its judgment the public convenience and welfare will <br />not be substantially served by the use of the premises <br />described in the petition and that such use may tend to impair <br />the status of the neighborhood, for the following reasons: - <br />The garage is partially within a residential zone; the build- <br />ing is of the type intended for accessory use; the use for <br />a repair shop for automolbilm would tend to interfere with <br />the comfort of adjoining residents and would tend to injure <br />the value of adjacent property in the residential zone. <br />Cs7 <br />1 <br />The Board therefor determines that the application ' <br />of section nine of the Lexington Zoning By-law does not <br />permit the use of the premises described in the petition and <br />instructs the Inspector of Buildings of Lexington not to <br />
