17 <br />MEETING - AUGUST 18, 1929. <br />A meeting of the Board of Appeals was held at <br />the Selectmen's Room, Town Office Building at 8 P.M. <br />Messrs. Roland W. Baldrey, Theodore A. Custance, C. <br />Edward Glynn, and Arthur N. Maddison were present. <br />Helen C.Whittemore was also present. Town Counsel, <br />Syd ey R. Wrightington was also present. <br />The Board took up the refusal of the appeal of <br />Minnie B. Stevenson. <br />Mr. C. Edward Glynn moved that the petition of <br />Minnie B. Stevenson for permission to use a lot located <br />on Vine Brook Road which contains less than 7,500 <br />square feet in area to build a dwelling thereon, be <br />denied. Stevenson <br />The Board discussed the matter from va^ious angles. hearing. <br />The question of establishing a building line on Waltham <br />Street and Vine Brook Road over the business district <br />was also considered. The Board felt that this was some- <br />thing that the Planning Board should consider. After <br />consideration the Board voted to deny the petition <br />of Minnie B. Stevenson and passed the following order: <br />The Board of Appeals, acting under General Laws, <br />Chapter 40, sec. 27, having received a written petition Order. <br />addressed to it by Minnie B. Stevenson, a copy of which <br />is hereto annexed, held a public hearing thereon of which <br />notice was mailed to the petitioner and to the owners <br />of all property deemed by the Board to be affected <br />thereby as they appear on the most recent local tax <br />list, and also advertised in the Lexington Times - <br />Minute Man, a newspaper published in Lexington, which <br />hearing was held in the Selectmen's Room in the Town <br />Office Building on the 26th day of July 1929 at 8:00 <br />o'clock P.M. A majority of the members of the Board of <br />Appeals were present at the hearing. A certificate of <br />notice is hereto annexed. At a meeting of the Board <br />duly called and held in the Selectmen's Room, Town <br />Office Building on August 1, 1929 at eight P.M., at <br />which a majority of the Board were present, further evidence <br />was received from the petitioner. At these hearings <br />evidence was offered on the part of the petitioner <br />tending to show that the petitioner, owning a large <br />lot sold the major portion of it and recorded the deed <br />after completion of the publication of the amended <br />Zoning Law and that he had not reserved for himself <br />sufficient land to provide the frontage and area re- <br />quired for a lot in a residential district under the <br />amended Zoning Law. <br />At a meeting of the Board duly called and held in <br />the Selectmen's Room of the Town Office Building on <br />August 16, 1929 at 7:30 P.M. at which a majority of <br />the Board were present, the Board in private session gave <br />consideration to the subject of the petition and voted <br />unanimously in favor of the following findings: <br />
