Adjourned Session —1999 Annual Town Meeting March 22, 1999 <br /> ARTICLE 5: ZONING BY -LAW, ADJUSTMENTS <br /> SECTION 9, RESIDENTIAL DEVELOPMENTS <br /> 9:18 P.M. Presented by Anthony Galaitsis, Planning Board. <br /> Mr. Galaitsis moved that the article be Indefinitely Postponed. <br /> 9:18 P.M. Following a voice vote, the Moderator declared the article INDEFINITELY <br /> POSTPONED. <br /> ARTICLE 6: ZONING BY -LAW, TECHNICAL CORRECTIONS <br /> 9:18 P.M. Presented by John Davies, Planning Board. <br /> Mr. Davies moved that the report of the Planning board on Article 6 be accepted and placed <br /> on file. Following a unanimous voice vote, the Moderator declared the report accepted and <br /> placed on file. <br /> -------------------------------- <br /> MOTION: That the Zoning By -Laws of the Town be amended as set forth in the <br /> motion and attached to the report of the Planning Board and filed with the Town <br /> Clerk. <br /> (MOTION of Planning Board Report): <br /> That the Zoning By -Law be amended in various sections, as follows: <br /> Amendment Al by adding a new section 1.7 as follows: <br /> "1.7 HEADINGS <br /> Headings, subheadings and captions at the head of subsections and paragraphs are for <br /> reference only and are not substantive provisions of the Zoning By -Law. They are not <br /> legally adopted parts of the Zoning By -Law as voted by Town Meeting." <br /> Amendment A2 In Section 2, DEFINITIONS, in the definition STORY by deleting the <br /> words ".... but not including a cellar, a crawl space, ...." so that the definition, as amended, <br /> will read: <br /> STORY: That portion of a building contained between any floor and the floor or roof next <br /> above it or the uppermost portion so contained if under a sloping roof and not accessible, <br /> by an approved stairway, or not designed or intended for human occupancy. <br /> In Section 2, DEFINITIONS, in the definition CELLAR, by deleting the second sentence <br /> which reads: "A cellar shall have a floor -to- ceiling height of seven feet or greater." <br /> In Section 2, DEFINITIONS, in the definition CRAWL SPACE, by deleting the existing <br /> definition and inserting in place thereof the following: <br /> "CRAWL SPACE: A space under a building not designed or intended for human <br /> occupancy or use that provides access to the underside of the building and has a height <br /> between the ground or floor level of the crawl space and the underside of the floor above it <br /> of not more than four feet." <br /> In Section 7, Dimensional Controls, by striking out subparagraph 7.5.5 Parking Within <br /> Building in its entirety and by substituting in place thereof the following: <br /> "7.5.5 CALCULATION OF STORY" <br /> For the purposes of calculating the height of buildings in stories, a story shall not include: a <br /> cellar, a parking level, a crawl space or any other floor area not designed or intended for <br /> human occupancy provided its height is not more than four feet above the lower elevation as <br /> described in subparagraph 7.5.1.a. In the case of a sloping site, the height of such floor area <br /> above the lower elevation may be calculated using the procedure in subparagraph 7.5.3. <br /> Average Height Of Building. Where different parts of the space below the first floor would <br /> be classified as a crawl space, a cellar, or a basement, the number of stories shall be <br /> calculated as if the classification of space that comprises the greatest percentage of area <br /> covered the entire space below the first floor." <br />
