The Chairman, Ms. Jeanne K. Krieger, asked if they will be able to maintain the trees <br />on the property (yes). <br />Mr. Clifford asked if the air conditioning unit will have to be moved because of the <br />addition (yes, but they are not sure where yet, but it will most likely be moved to the <br />rear of the lot). Mr. Clifford asked Ms. Bentley if it would be problematic if the Board <br />made it a condition to move the air conditioning unit from the side (No, it wouldn’t be <br />an issue). <br />A Board Member, Mr. David G. Williams, stated that the unit should not be in the <br />setback and they should move it as far back as possible. <br />There were no further questions or comments from the Board. <br />There were no questions from the audience. <br />The Chairwoman closed the hearing at 7:44 pm. <br />On a motion by Martha C. Wood and seconded by Edward D. McCarthy, the Board <br />voted 5-0 to grant a SPECIAL PERMIT in accordance with the Zoning By-Law <br />(Chapter 135 of the Code of Lexington) sections 135-9.4 and 135-8.4.2, to allow <br />modification to a non-conforming structure with the condition that the air conditioning <br />unit be moved to the back of the property and be placed outside of the required <br />setbacks. <br />September 28, 2017 <br />ZBA Meeting Page 3 <br /> <br />
