REPORT OF TOWN CLERK 71 <br />Article 34. To see if the Town will vote to appropriate <br />a sum of money to satisfy the judgment entered against the <br />Town in. the case of Anthony Ross & Son v Town of Lex- <br />ington. <br />The Appropriation Committee recommends that the sum <br />of $1,738.55 be appropriated under this Article. <br />Article 35. To see if the Town will vote to transfer <br />unexpended balances in any of the accounts to the Excess <br />and Deficiency Account or to any of the other Town Sur- <br />plus Accounts. <br />The Appropriation Committee recommends the f allowing <br />transfers under this Article: <br />From Fire Alarm Boxes account to Excess & Deficiency <br />account $13.00. <br />From Highway Construction—Gleason Road No. 1 to Ex- <br />cess & Deficiency account $222.23. <br />From Water Construction --Pinewood & Summit Roads <br />account to Water Dept. Available Surplus $868.30. <br />Article 36. To see if the Town will vote to establish as <br />a town way or accept the layout of as a town way, Tower <br />Road, from Massachusetts Avenue a distance of approxi- <br />mately 455 feet southerly, as laid out by the Selectmen, un- <br />der the Betterment Act, and shown upon a certain plan on <br />file in the office of the Town Clerk, dated February 10, 1936, <br />and to take by eminent domain the necessary easements <br />therefor, and appropriate money for the construction of <br />said street, or act in any manner relating thereto. <br />The Appropriation Committee recommends that this <br />Article be indefinitely postponed. <br />Article 37. To see if the Town will vote to establish <br />as a town way or accept the layout of as a town way, Rich- <br />ard Road, from Tower Road to near Plymouth Road, a dis- <br />tance of approximately 275 feet, as laid out by the Select- <br />men, under the Betterment Act, and shown upon a certain <br />plan on file in the office of the Town Clerk, dated February <br />10, 1936, and to take by eminent domain the necessary ease- <br />ments therefor, and appropriate money for the construction <br />of said street, or act in any manner relating thereto. <br />The Appropriation Committee recommends that this <br />Article be indefinitely postponed. <br />72 TOWN OF LEXINGTON <br />Article 38. To see if the Town will vote to establish <br />as a town way or accept the layout of as a town way, Plym- <br />outh Road, from Richard Road to Robbins Road, a distance <br />of approximately 585 feet, as laid out by the Selectmen, un- <br />der the Betterment Act, and shown upon a certain plan. on <br />file in the office of the Town Clerk, dated February 10, 1936, <br />and to take by eminent domain the necessary easements <br />therefor, and appropriate money for the construction of said <br />street, or act in any manner relating thereto. . <br />The Appropriation Committee recommends that this <br />Article be indefinitely postponed. <br />Article 39. To see if the Town will vote to establish as <br />a town way or accept the layout of as a town way, Hibbert <br />Street, from Massachusetts Avenue southwesterly, a dis- <br />tance of approximately 230 feet, as laid out by the Select- <br />men, under the Betterment Act, and shown upon a plan on <br />file in the office of the Town Clerk, dated February 15, 1936, <br />and to take by eminent domain the necessary easements <br />therefor, and appropriate money for the construction of said <br />street, or act in any manner relating thereto. <br />The Appropriation Committee recommends that this <br />Article be indefinitely postponed. <br />Article 40. To see if • the Town will vote to purchase <br />or take by eminent domain for highway purposes a parcel <br />of land approximately 23,286 square feet in area, now owned <br />by the Boston & Maine railroad, and used as an entrance to <br />and exit from the Lexington Railroad station, and provide <br />funds therefor by direct appropriation. <br />The Appropriation Committee recommends that this <br />Article be indefinitely postponed. <br />Article 41. To see if the Town. will vote to take for <br />highway purposes the following described parcel of land, be- <br />ing the northerly side of Depot Park, approximately 9,000 <br />square feet in area, and appropriate the sum of $2,000' for <br />excavating and resurfacing the same to be used for a public <br />parking space. <br />The Appropriation Committee • recommends that this <br />Article be indefinitely postponed. <br />
