Selectman Mr. Ferguson offers the following <br />motion. <br />Voted : That the suni of '$908.60 be appropriated to pay <br />the bill of Anthony Ross & Son for work done for the Pari: De- <br />partment and Highway Department in 1929 and 1930, and <br />that this amount be transferred from the Excess and Deficien- <br />cy Account. <br />General discussion by the following: Messrs. Hutchinson, <br />Coburn, Cutter, McCabe, representing Anthony Ross & Son. <br />Mr. William Greeley rises for point. of order. Decision by the <br />Moderator the speaker in order. <br />Mr. Hutchinson moves for indefinite postponement. <br />The question of the main motion was carried unanimous- <br />ly at9:01P.M. <br />Article 2.1. Selectman Mr. Ferguson offers the following <br />motion. <br />Voted: That the sura of $22.75 be appropriated to pay an <br />unpaid bill of the Police Department for the year 1934, and <br />that this amount be transferred from the Excess and Deficien- <br />cy Account. Carried Unanimously 9 :02 P. M. <br />Article 24. Selectman Mr. Ferguson offers the following <br />notion. <br />Voted: That the sum of $1450. be appropriated and trans- <br />ferred from the fnsura.nce Account to pay for an appraisal of <br />Town property. <br />Discussion—Messrs. M. <br />Question of doubt. <br />114 TOWN OF LEXINGTON <br />Moderator states in question of doubt necessary for fifteen <br />doubters to be present. On canvass of doubters eight arose, <br />therefore original decision of Moderator in order. 9:10 P. M. <br />Article 28. Selectman Mr. Ferguson offers the following <br />motion. <br />Voted: That the sum of $1,000.00 be appropriated for the <br />Cary Memorial library Account and that this amount be trans- <br />ferred from the Excess and Deficiency Account. Carried Unan- <br />imously 9 :11 P. M. <br />Article 25. Selectman Mr. ]Ferguson proves to take up <br />Article 25. <br />Mr. J. Henry Duffy, Chairman, Planning Board offers the <br />following motion. <br />Voted: That the Town amend the Lexington Zoning By - <br />Law by adding to Section 4, R.. 1 Districts, paragraph 6. the <br />following paragraph : <br />"e.. Excavation and removal from the premises of any <br />loam, sand, gravel, clay or quarried or crushed stone, except <br />when incidental to and in connection with the construction of <br />a building for which a permit has been issued in accorflance <br />with the Building Hy --Laws, and except when incidental to and <br />in connection with the normal and lawful development of the <br />property concerned." <br />Mr. Duffy reads report as follows: <br />REPORT OF THE PLANNING BOARD ON PROPOSED <br />AMENDMENT TO ZONING BY-LAW RELATIVE TO <br />REMOVAL OF LOAM, GRAVEL, ETC. <br />'I']re Planning Board is of the opinion that, this amendment <br />should be written into the Lexington Zoning By -Law, so that in <br />the future no wholesale removal of loam, sand, gravel, etc. can <br />take place without: a public bearing and the welt -considered ap- <br />proval of some responsible authority. Strictly speaking, the <br />present By --Law covers situations of this sort, because large- <br />scale removal of loam, sand or gravel is truly a business enter- <br />prise, and as such is prohibited in a residential zone. However, <br />with specific mention of this matter in the text of the By -Law, <br />no excuse will remain for administrative officials to allow such <br />
