9row14 o1' LV1INGTb1I 1.29 <br />pors.ry and conditional structures and uses that do not con- <br />form to the regulations herein prescribed, provided that no <br />such permit shall be for more than a one year period. <br />(c) Permit production of articles in whole or substan- <br />tial part from materials excavated or grown upon the <br />premises. <br />(d) Permit ;in anyl district any use obviously in- <br />tended, because harmonious, compatible, accessory, or neces- <br />sary or public convenience which has not been specifically <br />mentioned. <br />GENERAL PROVISIONS <br />Section 16, Existing Building. Any building or part <br />of a building which, at the time of the adoption of this <br />Ma -law, is being put to a non -conforming use may continue <br />to be used for the same purpose or for purposes not <br />substantially different, and may be repaired, rebuilt or <br />structurally altered; but no such building shall be extend- <br />ed or enlarged except upon written approvtl of the Plan- <br />ning Board a duly advertised public hearing by the select- <br />men and a permit thereafter signed by the selectmen. <br />Section 17. District Boundaries. The district bound- <br />aries shall be as shown on the zoning map. When bound- <br />aries run between streets and approximately parallel to <br />them they shall be deemed to follow a mean line between <br />said streets except that any such boundary when bounding <br />the rear of a business district or where paralleling a street <br />through a relatively undeveloped area shall be not more <br />than one hundred feet inward from the building line of such <br />street. <br />Section 18. In residence districts designated as RI <br />and R2, and in C1 districtsdesignated at the following <br />points, namely, junction of Waltham and Middle Streets <br />known as Grape Vine Corner; junctions of Middle and <br />Spring Streets; junction of Lincoln, School and Marrett <br />Streets commonly known as Five Forks; junction of Walt- <br />ham Street and Concord Avenue; and junctions of Woburn <br />and Lowell Streets, a front yard or a service yard of at <br />least twenty feet in depth between the exterior line of <br />the street and the adjacent line of any porch or building <br />shall be provided for every lot of land, and no new build- <br />ing or structure shall be constructed and no building os <br />structure shall be moved, altered, reconstructed. enlarge() <br />or rebuilt in such districts so that a yard less in depth shan <br />result; except that this section shall not apply to buildings <br />1th ANNUAL REPORT <br />ronting on streets on which building lines shall have 'been <br />.necially established according to law during or subsequent <br />to the year 1924. <br />Section 19. Variations. Where this by-law imposes a <br />greater restriction upon the use of buildings or premises <br />than is imposed by existing provisions of law or by-laws <br />the povisions of this by-law shall control. <br />Section 20. Plats. Wherever required by the building <br />inspector for his information, applications for building per- <br />mits shall be accompanied by a plan of the lot in duplicate, <br />drawn to scale, showing the actual dimensions of the lot, <br />and the exact location ,and size of buildings already upon <br />the lot, and of the building to be erected, together with <br />streets and alleys on and adjacent to the lot. A record of <br />such applications and plats shall be kept on file in the office <br />of the building inspector. <br />Section 21. Enforcement. Except as otherwise pro- <br />vided, this by-law shall be administered by the building in- <br />spector. He shall approve no application of any kind, plans <br />and specifications and intended use for which are not in all <br />respects in conformity with this by-law. <br />Section 22. Occupancy Permit. No building erected, <br />altered or in any way changed as to construction or use <br />under a permit or otherwise, shall be occupied or used with- <br />out an occupancy permit signed by the building inspector, <br />which permit shall not be issued until the building and its <br />uses and accessory uses comply in all respects with this <br />by-law. <br />Section 23. Appeals. Any person aggrieved by the <br />refusal of the building inspector to issue a permit on ac- <br />count of the provisions of this by-law or any person who is <br />aggrieved by the issuance of a permit or by a decision of the <br />building inspector made under the provisions of this by-law, <br />may by giving the building inspector and the board of appeal <br />notice in writing within ten days from the date of the is- <br />suance of the permit or of the decision appealed from, ap- <br />peal to the selectmen, or to such officer, board, commission or <br />committee as shall be appointed or designated by the select- <br />men to act as a board of appeal, who shall give notice and a <br />public hearing before rendering a decision, and record all <br />decisions and the reasons therefor. <br />Section 24. Amendment. The planning board, upon, <br />petition signed by fifty per cent in valuation of the prop- <br />
