<br />estate to amend or alter any of the provisions of this by-
<br />law, the selectmen shall give a public hearing, but seven
<br />days before such hearing is given, the selectmen shall pub-
<br />lish a notice thereof in one or more local papers and shall
<br />also mail a notice of such petition to each property owner
<br />within one-half ,mile of the location specified In such
<br />petition.
<br />Thereupon, After some discussion, and in view of
<br />the 1Town by-law allowing but ten minutes' debate upon
<br />motions to amend, since such motions are subsidiary mo-
<br />tions, Mr. Kilgour with the unanimous consent of the meet-
<br />• ing withdrew his motion to substitute.
<br />The entire matter was thoroughly discussed by Mr.
<br />Emery as the proponent for the majority report any By-
<br />law and by Messrs. Kilgour and Wesley T. Wadman as
<br />proponents for the minority Report. Further remarks
<br />were made by Messrs. Robert P. Clapp, Edwin B. Worthen,
<br />Charles S. Cutter.
<br />Mr. Arthur E. Hutchinson, after debate, moved that
<br />the motion of Mr. Emery be indefinitely postponed. Upon
<br />a voice vote, the Moderator declared the motion of Mr.
<br />Hutchinson to be lost; and more than twenty (20) :people
<br />having arisen to doubt the vote, a rising vote was taken
<br />which resulted as folows:

<br />And the motion was declared lost.
<br />Mr. Robert P. Clapp then moved that Section 23 of
<br />the By-law proposed in Mr. Emery's motion be amended by
<br />striking out on the 11th and following lines these words:
<br />"Or to such officer, Board, Commission or Committee
<br />as shall be appointed or designated by the Selectmen to
<br />act as a Board of Appeal." And thereupon the amendment
<br />was accepted by Mr. Emery and the seconder of the motion.
<br />Mr. Roger P. Innalls then presented the following
<br />motion to amend the foregoing proposed By-law, which in
<br />turn, Mr. Emery and the seconder of the motion accepted.
<br />to wit. "that the business district laid out upon the man
<br />submitted by the Planning Board beginning at the souther'
<br />boundary of the car barn property on Bedford Street. in
<br />North Lexington, be extended on either side of said street
<br />only to the southerly line of the residence lot now occupied
<br />by Mr. Spidle- instead of to the Boston & Maine Railroad
<br />crossing as !aid out." And it ac 'ordance with this amend-

<br />ment thgs accepted as set forth, the Town Engineer,
<br />J. Henry' Duffy, Esq. accordingly altered the map referred
<br />to in Section 1 of the proposed By-law to conform to this
<br />accepted amendment.
<br />Mr. Edwin A. Bayley then moved to amend Section
<br />15 of the proposed By-law, by stricking out in the 4th and
<br />5th lines thereof, the words, "and- upon written approval

<br />amend prevailed and was duly passed by vote of the meet-
<br />ing. Mr. Bayley further moved that Section 16 of the
<br />Proposed By-law be amended by stricking out in lines (-)
<br />and 7 thereof, the words, "upon written approval of the
<br />Planning Board" and inserting after the word "except" in
<br />the 6th line thereof, the ;word "after" so that the last
<br />clause of said section should read as follows, "that no such
<br />wilding shall be extended or enlarged except after duiy
<br />advertised public hearing by the Selectmen and a permit
<br />toereafter signed by the Selectmen." Mr. Emery and
<br />the seconder of the motion duly accepted this amendment.
<br />Upon the suggestion of the moderator, Mr. Emery and
<br />the seconder of the motion duly accepted as an amendment,
<br />striking out in Section 1, in the 8 th and 9th lines thereof,
<br />the words, "dated February 18, 1924, and signed by the
<br />Plam'inr lion -d." and substituting in place thereof the
<br />words "filed with the Town Clerk ,at this meeting."
<br />And there upon the meeting duly voted upon and adopt-
<br />ed the motion of Mr. Emery as thus amended, which was
<br />in terms as follows: "Voted: that the following By -Law
<br />be and the same hereby is adopted:" Zoning By-law for
<br />the Town of Lexington.
<br />Section 1.. To promote the health, safety, convenience
<br />and welfare of its inhabitants, to lessen the dangers from
<br />fire, congestion, and confusion, and to improve and beau-
<br />tify the - town, the Town of Lexington, under the provisions
<br />of the General Laws, including Chapter 40, Section 25 to
<br />30, inclusive, and Chapter 143. Section 3, is hereby divided
<br />into four classes of zones ,or districts, defined and bound-
<br />ed on the zoning map prepared by J. Henry Duffy. Town
<br />Engineer, filed with the Town Clerk at this meeting,
<br />which map is hereby made a part of this by-law.
<br />Section 2. Definitions. In this by-law, the following
<br />terms shall have the meanings hereby assigned to them: --
<br />(a) One -family Dwelling is a detached dwelling in-
<br />tended and designed to be occupied by a single family.
