Whenever required by the building <br />inspector for his information, applications for building per- <br />mits shall be accompanied by, a plan of the lot in duplicate, <br />drawn to scale, showing the actual di :.eruions of the lot, <br />and the exact location and size of buildings already upon <br />the lot, and of the buildings to be erected, together with <br />streets and alleys on and adjacent to the lot. A record of <br />such applications and plats shall be kept on file in the office <br />of the building inspector. <br />Section 21. Enforcement. Except as otherwise pro- <br />vided, this by-law shall Le administered by the building in- <br />spector. He shall approve no application of any kind, plans <br />and specifications and intended use for which are not in all <br />respects in conformity with this by-law. <br />Section 22. Occupancy Permit. No building erected, <br />altered or in any way changed as to construction or use <br />under a permit or otherwise, shall be occupied or used with- <br />out an occupancy permit signed by the building inspector, <br />which permit shall not be issued until the building and its <br />uses and accessory uses comply in all respects with this <br />by-law. <br />Section 23. Appeals. Any person aggrieved by the <br />refusal of the building inspector to issue a permit on ac- <br />count of the provisions of this by-law or any person aggriev- <br />ed by the issuance of a permit or by a decision of the build- <br />ing inspector made under th provisions of this by-law. may <br />by giving the building inspector and the board of appeal <br />notice in writing within ten days from the date of the is- <br />suance of the permit or of the decision appealed from, ap- <br />peal to the selectmen. or to such officer. board. commision or <br />committee as shall be appointed or designated by the select- <br />men to act as a board of appeal, who shall give notice and a <br />public hearing ;before rendering a decision, and record all <br />decisions and the reasons therefor. <br />Section 24. Amendments. The planning board, upon <br />petition signed by fifty per cent in valuation of the prop- <br />erty affected, or upon its own initiative. shall hold public <br />hearings, fourteen days' published notice of which shall be <br />given, for the consideration of any amendments to this by- <br />law, and report to the Town its recommendations as to what <br />action should be taken. <br />Section 25. The invalidity of any sections or pro- <br />visions of this by-law shall not invalidate any other sec - <br />4y AN1NUAL ItEPO3T <br />tion or provisions thereof. <br />Sec. 26. This by-law shall take effect upon its ap- <br />proval by the Attorney General and publication. according <br />to law. <br />Mr. Kilgour thereupon moved to amend the motion <br />offered by Mr. Emery by substituting in place of the By- <br />law proposed by Mr. Papery the By-law proposed by the <br />Minority Comittee, which is in terries as follows: <br />TOWN OF LEXINGTON, ZONING BY-LAW. <br />Regulations as to the Use and Construction of Buildings. <br />ARTICLE 1 <br />Residence Purposes <br />Section 1. Except as herein otherwise provided no <br />building within the borders of the Town of Lexington shall <br />be erected, altered, or used which is intended or desi;gned <br />for any other purpose except one or more of the folowing: <br />(a) A dwellin • for one or more families. <br />(b) A hotel, lodging or boarding house. <br />(c) A club other than a club which is carried on for <br />the purpose of making a profit. <br />(d) A church, school or academy. <br />(e) Other purposes which are not particular in- <br />dustries, trades or manufacturing. <br />(f) A railroad passenger station. <br />(g) A farm, truck garden, nursery or greenhouse. <br />(h) Any accessory purpose customarily incident to <br />the foregoing purposes. and which accessory purpose is <br />not detrimental or obnoxious to the districts where <br />situated. <br />ARTICLE 2 <br />Business Purposes. <br />Section 1. The following districts shall be design- <br />ated for the carrying on of commercial pursuits, and shall <br />also include any uses permitted under Article 1, namely: <br />District 1, On either side of Massachusetts Avenue <br />from Fottler Avenue East Lexington, to the northerly <br />line of Curve Street, East Lexington. <br />District 2. On either side of Woburn Street from the <br />
