CHAPTER 19, SECTION 37, REVISED LAWS. ACCEPTED AT A TOWN <br />MEETING MARCH 27, 1911. <br />SecTioN 37. In a town which by a vote of a majority of the <br />voters voting thereon at an annual or special town meeting accepts <br />the provisions of this section or has accepted the corresponding <br />provisions of earlier laws, the provisions of this chapter and the <br />rules made under the authority thereof which relate to the police <br />and fire forces of cities except Boston shall apply to all members of <br />the regular or permanent police and fire forces,or to thecail fire force, <br />or to either of said forces, of a town. Such vote may limit the <br />application of the provisions of this chapter and of the rules made <br />thereunder either to the police force or to the fire force of such <br />town, or it may extend such applicatiā€¢rn to both of said forces. <br />Upon such vote of acceptance, each member of the force or forces <br />included therein and within the classified civil service shall continue <br />to hold his office until his death, resignation or removal. <br />He shall not be removed except for cause shown after a full <br />hearing before the board or officer of the town having power to <br />make removals, and such member shall have the right to be present <br />at such hearing and to be represented by counsel. <br />(By vote of the town the provisions of the preceeding section are <br />to apply to the "regular or permanent members of the police force <br />of the town.) <br />REVISED LAWS, CHAPTER 104, SCCTtoNs 1 TO 10 BOTH INCLUSIVE. <br />ACCEPTED AT A TOWN MEETING MARCH 27, 1911. <br />SEcrroN 1. Every city, except Boston, and every town which <br />accepts the provisions of this section or has accepted the corres- <br />ponding provisions of earlier laws may, for the prevention of fire <br />and the preservation of life, by ordinances or by-laws not inconsis- <br />tent with law and applicable throughout the whole or any defined <br />part of its territory, regulate the inspection, materials, construction, <br />99 <br />alteration and use of buildings and other structures within its limits, <br />except such as are owned or occupied by the United States or by <br />the Commonwealth, and except bridges, quays and wharves, and <br />may prescribe penalities not exceeding one hundred dollars for each <br />violation of such ordinances or by-laws. <br />SEC. 2. In a town which accepts the provisions of this and the <br />following section or has accepted the provisions of earlier laws, no <br />dwelling house or other structure more than eight feet in length or <br />breadth and seven feet in heigth, except detached houses or struc- <br />tures situated more than one hundred feet from any other building <br />and wooden structures erected on wooden wharves, shall be built <br />within such limits as the town may from time to time prescribe, un- <br />less made of and covered with an incombustable material or unless a <br />license in writing is granted therefor by the selectmen for public <br />good or necessity and recorded in the town records. <br />SEc. 3. A building or structure which is erected in violation of <br />the provisions of the preceeding section shall be deemed a common <br />nuisance without other proof thereof than proof of its unlawful con- <br />struction and use; and the selectmen may abate and remove it in <br />the same manner as boards of health may remove nuisances under <br />the provisions of sections sixty-seven, sixty-eight and sixty-nine of <br />chapter seventy-five. <br />SEC. 4. In a city or town which accepts the provisions of this <br />and the eight following sections or has accepted the corresponding <br />provisions of earlier laws, the superintendent of public buildings or <br />such other officer as the mayor and aldermen of said city or the <br />selectmen of said town may designate shall be inspector of build- <br />ings, and, immediately upon being informed by report or otherwise <br />that a building or other structure or anything attached to or con- <br />nected therewith in said city or town is unsafe or dangerous to life <br />or limb, shall inspect the same ; and if it appears to him to be <br />dangerous, he shall forthwith in writing notify the owner, agent or <br />any person having an interest therein to remove it or make it safe <br />and secure. <br />100 <br />
