Minutes for the Meeting of November 20, 1989 3 <br /> 277. Pheasant Brook I. final release of surety: Ms. Nordby reported that the <br /> Town Engineer has indicated that all work has been completed to his satisfac- <br /> tion, and that there is no further need to hold any surety. On the motion of <br /> Mr. Sorensen, seconded by Mrs. Klauminzer, it was voted unanimously: <br /> WHEREAS, Francis X. Fields, Town Engineer, has indicated in a memorandum, <br /> dated October 6, 1989, that the "as-built" of the Pheasant Brook, Phase I <br /> plans have been approved, which means that all required community facilities <br /> in the Pheasant Brook, Phase I subdivision have been completed in accordance <br /> with the Town's standards; <br /> IT IS VOTED: <br /> 1) that the Planning Board returns the remaining surety, in the form of <br /> passbook # 60-064809 from the Merchants Co-operative Bank in the amount <br /> of $75,000, which was being held for the completion of the construction <br /> of the community facilities at the Pheasant Brook, Phase I subdivision; <br /> and <br /> 2) the covenant from Pheasant Brook Estates, Inc. , The Kahn-Quinn Group <br /> Ltd. , dated November 26, 1989, shall remain in force and effect until <br /> such time as the streets in the subdivision are accepted by the Town of <br /> Lexington as public streets. <br /> l1 278. Turnburry Hill. Otis Brown: The Board discussed a letter from Mr. Brown <br /> asking that the Board waive a requirement of the Special Permit and Certifi- <br /> J cate of Action so that the Building Commissioner can issue occupancy permits <br /> for two of the dwelling units in the development. Prior commitments of two <br /> residents will force them to move out of their present residences before the <br /> requirements of Item 12 under General Conditions of the Certificate of Action <br /> have been met, allowing them to move into their homes in Turnburry Hill. <br /> The Board was unsure whether or not a formal amendment to the subdivision plan <br /> and a public hearing would be required to waive Item 12 of the General <br /> Conditions. They agreed to ask Town Counsel for an opinion. <br /> 279. Pheasant Brook II. Robert Cataldo. Action on Definitive Subdivision <br /> Plan: The Board reviewed and corrected a draft Certificate of Action, dated <br /> November 22, 1989, approving the definitive plan. On the motion of Mr. <br /> Sorensen, seconded by Mrs. Klauminzer, it was voted 4-0-1 (Mrs. Uhrig ab- <br /> stained as she had not attended the meeting) to approve the definitive plan <br /> and the Certificate of Action, as amended. <br /> The Board reviewed and corrected a draft Special Permit with Site Plan Review, <br /> dated November 22, 1989, granting the special permit. On the motion of Mr. <br /> Sorensen, seconded by Mrs. Klauminzer, it was voted 4-0-1 (Mrs. Uhrig ab- <br /> stained as she had not attended the meeting) to grant the Special Permit with <br /> Site Plan Review, and to approve the wording of the decision on the Special <br /> Permit with Site Plan Review, as amended. <br /> ***************************** AFFORDABLE HOUSING **************************** <br /> 280.
