<br />Minutes of the Lexington Zoning Board of Appeals <br />Virtual, Via Zoom <br />December 14, 2023 <br /> <br />Board Members: Chair – Ralph D. Clifford, Nyles N. Barnert, Norman P. Wood <br /> <br />Alternate Member: Kathryn Roy <br /> <br />Administrative Staff: Julie Krakauer Moore, Zoning Administrator and Sharon Coffey, <br />Administrative Clerk <br /> <br />Address: 1265 Massachusetts Avenue <br /> <br />The petitioner is requesting a SPECIAL PERMIT RENEWAL in accordance with the Zoning By- <br />Law (Chapter 135 of the Code of Lexington) section(s) 135-9.4 and 135-3.4 Table 1 (Permitted <br />Uses and Development Standards), Lines C.1.03 and P.1.02 to operate a nursery and retail <br />garden center, to allow the seasonal sale of Christmas trees and wreaths, and to extend regular <br />business hours during Spring and Christmas seasons. <br /> <br />The petitioner submitted the following information with the application: Nature and Justification, <br />plans, comments from the Building Commissioner, comments from the Zoning Administrator, <br />and a plot plan waiver request. <br /> <br />Prior to the meeting, the petitions and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning <br />Director, the Historic District Commission Clerk, Historical Commission, Economic <br />Development, and the Zoning Administrator. Comments were received from Building <br />Commissioner and the Zoning Administrator. <br /> <br />The Hearing was opened at 7:23 pm <br /> <br />Presenter: Laura Hopkins and Jessica Michalek on behalf of Seasons Four <br /> <br />Ms. Laura Hopkins presented the petition along with Jessica Michalek on behalf of Seasons <br />Four. She requested that SPECIAL PERMIT be granted renewal to allow for extended business <br />hours during Spring and Christmas seasons and to allow to continue to keep operating a <br />nursery and retail garden center. Ms. Hopkins asked for the Board to consider altering the <br />SPECIAL PERMIT renewal time requirement from 5 years to 10 years. <br /> <br />Board Member, Nyles N. Barnert, asked the Petitioner is the same conditions are still accurate <br />for this renewal? (Ms. Hopkins stated, yes) <br /> <br />Board Member, James A. Osten, commented that he is impressed that there have been no <br />complaints from abutters against Four Seasons, while other similar businesses have had <br />complaints previously. <br /> <br />Chair, Ralph D. Clifford, asked the zoning administrator if there had been any complaints <br />against Four Seasons (No complaints that the Zoning Administrator is aware of) <br /> <br />No further questions from the board. <br /> <br />
