<br /> <br /> <br /> <br />Minutes of the Lexington Zoning Board of Appeals <br />Virtual, Via Zoom <br />July 27, 2023 <br /> <br />Board Members: Chair – Ralph D. Clifford, Norman P. Cohen, Martha C. Wood, James Osten <br />and Associate Member David Williams <br /> <br />Administrative Staff: Julie Krakauer Moore <br /> <br />Address: 75 Fottler Ave <br /> <br />The petitioner is requesting a SPECIAL PERMIT MODIFICATION in accordance with the Zoning <br />By-Law (Chapter 135 of the Code of Lexington) section(s) 135-5.1.11(1) and 135-5.1.14 to allow <br />a driveway to be closer to the lot line than otherwise allowed. <br /> <br />The petitioner submitted the following information with the application: Nature and Justification, <br />Elevations, Floor Plans, Gross Floor Area Calculations and a Letter from an Abutter. <br /> <br />Prior to the meeting, the petitions and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning <br />Director, the Historic District Commission Clerk, Historical Commission, Economic <br />Development, and the Zoning Administrator. Comments were received from the Zoning <br />Administrator, the Building Commissioner, the Engineering Department and the Planning <br />Department. <br /> <br />The Hearing was opened at 7:03 pm <br /> <br />Presenter: Xinyu Zhan <br /> <br />Ms. Zhan presented the petition. She stated at the previous Hearing she was requested to <br />resolve the parking issue permanently. They have looked at many ways to do this. They will tear <br />down the old retaining wall, fill with soil and connect the parking with the lot line. <br /> <br />The Board questioned the shed (The shed has to be removed). <br /> <br />Chair, Ralph D. Clifford, asked if they are working with an engineer to make sure there are no <br />water issues (According to the engineer that designed this the level will be the same as the <br />street). <br /> <br />Mr. Clifford questioned if there is a guard rail between the properties (Not necessary). <br /> <br />A Board Member, James Osten, questioned how many cubic yards of fill will be brought in to <br />make the driveway level (Not sure, the area is about 19 feet long, 18 feet wide and 5.8 feet <br />high). <br /> <br />The Zoning Administrator, Julie Krakauer Moore, stated the fill bylaw does not apply when it is in <br />conjunction with a construction project. The homeowner will not need a Special Permit for the <br />fill. <br /> <br /> <br />
