On a motion by Ms. Ladd and seconded by Ms. Dohan, the Commission voted 6-0 by roll call <br />vote to issue the Order of Conditions. <br /> <br />Record of Vote as Follows: <br /> <br />Duke Bitsko – Aye <br />Alex Dohan – Aye <br />Ruth Ladd – Aye <br />Holly Samuels – Aye <br />Jason Hnatko – Aye <br />Phil Hamilton – Aye <br /> <br />6:45 PM <br /> <br />127 North Street compliance restoration approval (DEP#201-1137, BL# 1094) <br /> <br />Mr. Rich Kirby, LEC Environmental Consultants, and Mr. Al Gala, Gala Simon Associates, <br />presented to the Commission. A Floodplain and Buffer Zone Restoration Sketch (revised <br />2/21/23) was shared with the Commission. Ms. Samuels asked what the maintenance and overall <br />plan of care would be for the three oaks proposed to be planted on town land. Mr. Kirby <br />responded that these trees could be maintained as part of the restoration planting plan, and for a <br />minimum of two growing seasons. Ms. Samuels also asked if the trees will be protected from <br />deer and rabbit browsing. Mr. Kirby responded that he recently saw success at an Arlington DCR <br />site where the stems of the trees were surrounded with a bendable plastic material that went from <br />the ground up about 3 feet up, and that this could be implemented on the sapling trees. When <br />asked if there would be any risk of animal browsing on the planted shrubs, Mr. Kirby responded <br />that the property owner could plant additional shrubs to offset any that may not survive or install <br />a chicken wire fence to keep rabbits out of the restoration area. <br /> <br />On a motion by Ms. Samuels and seconded by Ms. Ladd, the Commission voted 6-0 by roll call <br />vote to approve the restoration plan with conditions such as deer browse protection and <br />survivability and monitoring on Conservation land. <br /> <br />Record of Vote as Follows: <br /> <br />Duke Bitsko – Aye <br />Alex Dohan – Aye <br />Ruth Ladd – Aye <br />Holly Samuels – Aye <br />Jason Hnatko – Aye <br />Phil Hamilton – Aye <br /> <br />7:02 PM <br /> <br />Ms. Mullins clarified that the Certificate of Occupancy can be signed off on by Conservation, <br />and that, if the property is being transferred to a new owner, a signed statement for understanding
