Minutes of the Lexington Zoning Board of Appeals <br />Virtual, Via Zoom <br />December 8, 2022 <br /> <br />Board Members: Chair – Ralph D. Clifford, Martha C. Wood, Norman P. Cohen, Nyles N. <br />Barnert and James Osten <br /> <br />Administrative Staff: Jim Kelly, Building Commissioner Julie Krakauer Moore, Zoning <br />Administrator and Sharon Coffey, Administrative Clerk <br /> <br />Address: 1756 Massachusetts Avenue <br /> <br />The petitioner is requesting SPECIAL PERMIT in accordance with the Zoning By-Law (Chapter <br />135 of the Code of Lexington) section(s) 135-9.4 and 135-3.4 Table 1 (Permitted Uses and <br />Development Standards) to allow fast food use in the CB Zoning District. <br /> <br />The petitioner submitted the following information with the application: Nature and Justification <br />and floor plans. <br /> <br />Prior to the meeting, the petitions and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning <br />Director, the Historic District Commission Clerk, Historical Commission, Economic <br />Development, and the Zoning Administrator. Comments were received from the Zoning <br />Administrator, Building Commissioner, Health Department, Select Board’s Office and Planning <br />Department. <br /> <br />Presenter: Fred Fleisher, at 1315 South Street Needham, on behalf of When Pigs Fly <br /> <br />The Hearing was opened at 7:06 pm. <br /> <br />Fred Fleisher presented the petition. He stated they got a great deal of feedback from <br />customers who are excited about this opportunity. They serve bread, doughnuts, breakfast <br />pastries, scones, muffins and coffee. They want people to have a place to sit to meet their <br />friends, have a coffee and a scone. <br /> <br />A Board Member, Nyles N. Barnert, questioned the hours of operation (10 am to 6 pm). <br /> <br />A Board Member, James Osten, clarified if they are asking for 6 seats and a counter at the <br />outside window and asked what type of seats will be used (Correct. Padded stools). <br /> <br />Mr. Osten questioned if they have an occupation limit for the premises (One was not granted <br />because this is retail and take-away. This is the first time they have had seating. He doesn’t <br />believe this would be necessary). <br /> <br />There were no further questions from the Board. <br /> <br />No questions or comments from the audience. <br /> <br />Mr. Fleisher stated they have been open for over a week and its been an amazing week. They <br />are excited to be a place people can go to and meet their friends. <br /> <br /> <br />
