November 8,2021 Special Town Meeting#1(2021-1),cont. <br /> 9:45 p.m. Jessie Steigerwald,Pct. 8,asked how the Planning Board would feel based on the results <br /> of the vote and whether he had a sense from Town Meeting based on the discussion. <br /> Mr.Hornig stated that they would have a sense more from the vote rather than the <br /> discussion and that how the vote was enacted would help them see if the Town were <br /> willing to make changes with real effects and that this would help set the Board's <br /> priorities and goals pursuing DEI moving forward. <br /> 9:48 p.m. Melinda Walker,Pct. 8,spoke in favor of the Article and stated that common sense would <br /> need to be applied about whether certain things had impact on DEI and that she looked at <br /> this as an opportunity for the Town and could help first time home buyers. She noted that <br /> the Town could insist that more first time homebuyer and affordable housing <br /> opportunities become available for people who would like to participate and for people to <br /> be able to take advantage of—mostly being homeowners. She appreciated that the <br /> Planning Board had taken this on as a first step. <br /> 9:51 p.m. Richard Canale,Pct.9,planned to vote yes,but wished section 1 had stronger language <br /> and hoped that in the future,it would be strengthened to move toward better equality and <br /> equity. <br /> 9:58 p.m. The Moderator called the vote on the Motion as Amended. <br /> Following remote electronic vote tallying,the Moderator declared that: <br /> Article 13,as Amended <br /> Adopted on a vote of: <br /> Yes No Abstain <br /> 163 10 9 <br /> MOTION CARRIES BY MORE THAN NECESSARY 2/3RDS <br /> 9:57 p.m. The Moderator declared Special Town Meeting#1 open under Article 14 <br /> ARTICLE 14:AMEND ZONING BYLAW-SOLAR ENERGY SYSTEMS <br /> To see if the Town will vote to amend the Zoning Bylaw to remove restrictions on, and streamline <br /> permitting for,solar energy systems,or act in any other manner in relation thereto. <br /> (Inserted by the Select Board at the request of the Planning Board) <br /> DESCRIPTION: This article would encourage construction of solar energy systems by permitting <br /> solar energy systems on nonconforming lots and wherever other structures are permitted, and by <br /> streamlining permitting for small-scale solar energy systems. <br /> MOTION: <br /> Mr.Peters moves that the Zoning Bylaw,Chapter 135 of the Code of the Town of Lexington,be <br /> amended as follows(setfglrtext is to be removed and underlined text is to be added),and <br /> further that non-substantive changes to the numbering of this bylaw be permitted to comply with the <br /> numbering format of the Code of the Town of Lexington: <br /> 1. In§135-3.4 Table 1,Permitted Uses and Development Standards,row 0.1.13 (Solar Energy <br /> System, Small-Scale),replace the symbol"R"with the symbol"Y"in every column in which <br /> it appears. <br /> 2. Amend§135-4.2.2 so that it reads: <br /> 4.2.2 Lot Regularity.No structure other than a Solar Energy System may be erected on any lot <br /> that does not have an area in which a circle,the diameter of which is 80%of the minimum lot <br /> frontage,tangent to the lot frontage and within all other lot lines,may be located. <br />
