2) By creating a new subsection "8.4 REZONING PROVISIONS APPLICABLE TO <br /> BOTH CD AND RD DISTRICTS"; <br /> 3) By redesignating the existing paragraph 3.6.3 FILING OF PRELIMINARY SITE <br /> DEVELOPMENT AND USE PLAN to be a new paragraph 8.4.1 and by <br /> redesignating the existing paragraph 3.6.4 DEFINITIVE SITE DEVELOPMENT <br /> AND USE PLAN and all cross references thereto, to be 3.6.3; <br /> 4) In the newly designated paragraph 8.4.1 in the second sentence, by striking out the <br /> word "seven" and inserting in place thereof the word "fourteen" so that the second <br /> sentence, as amended, will read: <br /> "8.4.1 FILING OF PRELIMINARY SITE DEVELOPMENT AND USE PLAN <br /> Subsequent to that public hearing,revisions to the preliminary site development and <br /> use plan may be filed with the Town Clerk and the Planning Board and must be filed <br /> at least fourteen days prior to the vote of the Town Meeting on the petition." <br /> B. In the newly created subsection, 8.4 REZONING PROVISIONS APPLICABLE TO BOTH <br /> CD AND RD DISTRICTS, by adding a new subparagraph 8.4.2, as follows: <br /> "8.4.2 AMENDMENTS TO THE PRELIMINARY SITE DEVELOPMENT AND <br /> USE PLAN <br /> After the filing of the preliminary site development and use plan which accompanies a <br /> petition for a rezoning, the Town Meeting shall not take favorable action on a proposed <br /> amendment to the preliminary site development and use plan: <br /> a. unless at least seven days prior to the vote of the Town Meeting on the petition a copy <br /> of the proposed amendment: <br /> 1) has been filed with the Town Clerk and the Planning Board, and <br /> 2) has been sent by registered mail to the applicant, if the proponent of the <br /> amendment is not the petitioner, <br /> b. the Moderator shall determine that the proposed amendment is within the scope of the <br /> petition and the preliminary site development and use plan most recently filed as <br /> provided in paragraph 8.4.1, and <br /> c. at least two thirds of the Town Meeting vote favorably on the proposed amendment." <br /> C. 1) In Section 8, Part A, PLANNED DEVELOPMENT DISTRICTS, in both paragraphs <br /> 8.2.4 and 8.3.4, SPGA, in the first sentence by adding the words "For rezoning <br /> petitions approved by the Town Meeting after the 1997 Annual Town Meeting,..." <br /> and by striking out the words ..."Board of Appeals".... and by inserting in place <br /> thereof the words ..."Planning Board" so that the sentence, as amended will read: "For <br /> rezoning petitions approved by the Town Meeting after the 1997 Annual Town <br /> Meeting, the Planning Board shall be the special permit granting authority."; and <br /> 31 <br />
