and 11) clarifying the setback requirements for driveways. <br /> or act in any other manner in relation thereto. <br /> (Inserted at the request of the Planning Board) <br /> DESCRIPTION: The Planning Board periodically submits an article which includes a <br /> number of amendments that: 1) correct omissions, typographical errors and cross refe- <br /> rences, 2)bring the wording of the By-Law into compliance with Chapter 40A, the Zoning <br /> Act, or court decisions, 3) clarify interpretations, 4) group provisions dealing with a subject <br /> into one section, and 5) update obsolete provisions and revisions in the By-Law. It is not <br /> the intent of this article to make changes that affect the substantive meaning of the Zoning <br /> By-law. <br /> ARTICLE 36 ZONING BY-LAW, NONCONFORMING <br /> PARKING, LEXINGTON CENTER <br /> To see if the town will vote to amend the Zoning By-Law in Section 6.6.1, Existing <br /> Nonconforming Parking Spaces, in the second paragraph,by adding a new subparagraph 3), as <br /> follows: <br /> "3) in the CB, Central Business, district, notwithstanding subparagraph 1), a restaurant, <br /> fast food, or other eating establishment (see parking factor 7) a. in subsection 11.3.1) <br /> may be substituted for a use with a lower parking factor." <br /> or act in any other manner in relation thereto. <br /> (Inserted at the request of the Planning Board) <br /> DESCRIPTION: The Zoning By-Law now provides that if a use with a higher parking <br /> demand (as required by subsection 11.3 of the By-Law) is proposed to be substituted for an <br /> existing use with a lower parking demand, the net increase in the number of parking spaces <br /> required must be constructed. That provision has prevented restaurants from using floor <br /> space previously occupied by stores or other uses with lower parking demand. The effect of <br /> the amendment will be to allow more restaurants to locate, or for existing restaurants to <br /> expand, in Lexington Center <br /> ARTICLE 37 ZONING BY-LAW,MAXIMUM, <br /> MINIMUM PARKING <br /> To see if the town will vote to amend the Zoning By-Law <br /> A. In subsection 11.3 Number of Parking Spaces, Loading Bays, in subparagraph 11.3.1: <br /> 1) In the heading of the second column, by adding the words "or Maximum" so that <br /> the heading, as amended, will read: "Minimum or Maximum Number of Parking <br /> Spaces" and by adding under that line in the heading the following words: "(The <br /> factors listed below shall be the minimum factor unless otherwise stated)" <br /> 2) In the column headed PARKING FACTOR,by striking out the existing wording <br /> and by inserting in place thereof: <br /> 28 <br />
