ARTICLE 32 ZONING BY-LAW, PERSONAL WIRELESS <br /> COMMUNICATION FACILITIES <br /> To see if the town will vote to amend the Zoning By-Law by adding a comprehensive new Section <br /> 15,that deals with personal wireless communication facilities which is the equipment that broadcasts <br /> and receives radio frequency waves for cellular,personalized communication, mobile radio,paging <br /> services and other wireless communication services. The proposed amendment will regulate where <br /> in town such equipment may be located,where on a lot such equipment may be located, the type of <br /> structure on which it may be located, its height, its appearance and will specify administrative <br /> requirements for granting permits. The amendment also includes changes to other sections of the <br /> Zoning By-Law that are affected by Section 15. All of the proposed amendment is set forth in a <br /> document entitled: "Zoning By-law, Personal Wireless Communication Facilities" that is on file and <br /> available for inspection in the offices of the Planning Board and the Town Clerk and in Cary Library, <br /> and as may be included in a report and recommendations by the Planning Board to be filed with the <br /> town meeting; or act in any other manner in relation thereto. <br /> (Inserted at the request of the Planning Board) <br /> DESCRIPTION: The Town's existing regulations are outdated relative to the technological <br /> explosion in the use of cellular telephones, paging services and other forms of personal <br /> wireless communication. The Federal Telecommunications Act of 1996 requires that <br /> municipalities grant permits for wireless facilities. The proposed amendment attempts to take <br /> a comprehensive approach to permitting wireless communications equipment in a manner <br /> consistent with the visual character of Lexington. <br /> The proposed amendment is about 8 pages long and, for cost reasons, is not reproduced here. <br /> The full text of the proposed amendment is also available on the Town's Web Page at <br /> http://link.ci.lexington.ma.us.; <br /> ARTICLE 33 ZONING BY-LAW, SMALL LOTS <br /> To see if the town will vote to amend the Zoning By-Law: <br /> in Section 7.4.1 Pre-Existing Residential Lots, by striking out the first paragraph and by inserting <br /> in place thereof the following: <br /> "LOT IN SEPARATE OWNERSHIP: In any district a lot, if used for a one-family or two-family <br /> dwelling, which: <br /> 1) at the time of recording or endorsement, as shown by the most recent instrument of record <br /> prior to the effective date of the zoning change from which the exemption is sought,was not <br /> held in common ownership with any adjoining land, <br /> 2) had at least 5,000 square feet of lot area and 50 feet of lot frontage, and <br /> 25 <br />
