Commissioners Present: Kevin Beuttell, Duke Bitsko, Alex Dohan, Philip Hamilton, Ruth Ladd, David Langseth and Holly Samuels Associate Members Present: Vinita Bose and Jason Hnatko Staff Present: Meghan McNamara, Department Assistant 6:30 PM New Business/Pendine Matters Informal discussion on deck project at 27 Brent Road, Rich Kirby, LEC Environmental Mr. Rich Kirby, LEC Environmental,presented a proposal to construct a ground level wooden deck at 27 Brent Road. A portion of the deck falls within the 25-foot no disturb zone. Members of the Commission said that proposed invasive species management would be beneficial and proposed planting would need to meet the new buffer zone standards. Request for Certificate of Compliance: 501 Marrett Road, ViewPoint Cloud Permit# COC-22-6, DEP4201-1087, BL 1044 Ms. Hailey Page, Weston & Sampson, and Ms. Devin Herrick, Weston & Sampson,presented an overview of the Certificate of Compliance request to the Commission. The Commission did not have any questions and will continue this request to the next meeting to allow for a site visit before issuance. Vote on the minimal Article 97 risk to allow the completion of the sewer connection at 46 Turning Mill Road per the Order of Conditions On a motion by Ms. Ladd and seconded by Mr. Langseth, the Commission voted 7-0 by roll call vote to approve the statement of Town Counsel as evidence of the applicant's compliance with the section of the OOC that requires resolution of the driveway encroachment. Mr. Bitsko requested a three-year guarantee for the plantings. Mr. Devlin stated that the project team will revisit the site in early Spring to determine what invasive species are growing so they know how to treat and target the species. The Commission decided that a plan will need to be submitted to the Conservation Commission by July 31, 2022 and it will be reviewed and approved by the Conservation Commission prior to implementation. Ms. Dohan asked about the area between Grove Street and Turning Mill Road and stated that erosion control has been in place and should have been removed many years ago. Mr. Devlin said that he is not aware of this site and will pass the message along. On a motion by Ms. Samuels and seconded by Ms. Ladd, the Commission voted 7-0 by roll call vote to approve the restoration plan as modified and required. Ms. Trudeau stated that after recalculations were performed, the increase in new impervious area at the site is 2,555 square feet. Mr. Russell stated that the as-built infiltration system is still adequate and asked if the new impervious surface needs to comply with the new rainfall standard. Chairman Hamilton responded that if the applicant was requesting to install this new impervious surface that they would be required to comply with the new rainfall standards. Mr. Langseth stated that he has concerns for how the large site was managed. Ms. Ladd, referring to the concrete surface directly west of Unit 48, asked why the pad extends much further than the mailboxes that are placed on it. Mr. Tim Sullivan, Seaver Construction, responded that the mailboxes on top of the concrete pad were smaller than anticipated and that Seaver Construction is proposing a bench to be placed in the remaining concrete pad area. Mr. Russell stated that he performed recalculations which show that the existing infiltration system would not be large enough to accommodate the additional 2,555 square feet of impervious coverage according to the current rainfall standards. Mr. Russell continued to say that if Building 42 was disconnected from the infiltration system then the as-built conditions would meet the current performance standards. This proposal will likely be presented at the next meeting. Mr. Langseth stated that the connection should remain in place. It was asked if additional cultec units could be installed to accommodate the additional runoff and to meet the performance standards. Mr. Russell responded, by disconnecting Building 42 from the infiltration system and instead allowing that runoff to run overland, that proposal would meet the performance standards. Members of the Commission are not agreeable to this approach. Mr. Russell stated that the proposed infiltration system 42 is replacing a depression that currently captures runoff from the existing driveway, front walkway and a portion of the front yard. A DEP filing number has not yet been issued. Questions and Comments from the Commission: — Can more tree protection be provided such as a temporary fence that is as close to the drop line of the trees as possible? Suspect the tree canopy is much larger than what is shown on the plan. — Can the proposed infiltration system 41 be shifted farther away from the tree root zone? — The shed is being proposed closer to the 50-foot buffer zone line and it was originally outside the 100-foot buffer zone. Can it be moved so it's not right up against the 50-foot? — Does the stormwater plan meet the standards for the entire site and not just the jurisdictional areas? — Need to include the 2-foot sump detail on the plan. — Is the 50% rule met? Please provide that information at the next meeting. Responses from the Representative: — Will look into providing more tree protection and shifting the infiltration system. — Wetlands that function as part of the existing drain system are on the right side of the lot. Suspect on the left side that the wetlands delineation will change. Shifting to the north actually keeps it from the more sensitive portions of the resource area. — The stormwater analysis captures the entire site as per the regulations. — Will check to make sure the 50% rule is met and will provide documentation. Mr. Novak stated there is an existing infiltration system underneath the location of the proposed depression that was installed to collect the garage roof runoff. Questions and Comments from the Commission: — Is the overflow to the town storm drainage system only when the water reaches at 285.5 at the rim of the crate? — What will be done to prevent clogging of the system? — There are trees close to the proposed depression. These trees could be taking up a lot of the water and the roots may be impacted by the excavation. Responses from the Representative: — Modeled as the entire drainage area and the design point is the rim of the catch basin. — The property owner will need to diligently maintain the system to prevent clogging. — The impact of excavation will be minimal but will likely impact the roots. The Commission will impose a special condition that any tree roots greater than two inches in diameter and up to 4 inches in diameter will need to be cleanly cut under the supervision of a certified arborist, and that any tree roots greater than 4 inches in diameter will either need the arborist to approve removal or will be required to remain in place. On a motion by Mr. Beuttell and seconded by Mr. Langseth, the Commission voted 7-0 by roll call vote to issue a Negative determination with conditions. Questions and Comments from the Commission: — Can the concrete pad take up parking spaces? There are currently dumpsters that take up parking spaces in close proximity. — Can the concrete pad be located on the opposite side of the hydrant? This option could take it out of the 50-foot zone. — Is there a health and/or safety reason that the pad can't be located elsewhere? — Need to see detailed stormwater calculations, even if minor. — Need to provide mitigation beyond what is typically required because of the project's proximity to wetlands and the stream and invasive species management should be considered. Responses from the Representative: — The Facilities Department said that the concrete pad cannot take up any parking spaces. — There is a public path in the way on the opposite side of the hydrant, but the project team did not consider relocating the path and/or the dumpsters. There is a water/sewer line within the pathway and would need to investigate further. — Were told by the Facilities Department that the pad has to be located where it is proposed for safety and access purposes. An abutter asked for confirmation that there are parking spaces located by the dumpster, and said that it does not appear so. Mr. Hamilton responded that there are parking spaces shown on the plan.
