Access Channel: A video Channel which the Licensee shall make <br /> available to the Town of Lexington and/or its designee(s) without charge for non-commercial <br /> public, educational, or governmental use for the transmission of non-commercial Video <br /> Programming as directed by the Town and in accordance with the terms of this Renewal License. <br /> 1.2. Access Corporation: The entity, designated by the Issuing Authority of <br /> the Town of Lexington, that is responsible for operating and managing the use of PEG Access <br /> Channels, facilities, funding and programming in the Town. <br /> 1.3. 4ffiliate: When used in relation to any Person, another Person who owns <br /> or controls, is owned or controlled by, or is under common ownership or control with, such <br /> Person. <br /> 1.4. Basic Service Tier: Any service tier which includes the retransmission of <br /> local television broadcast signals. <br /> 1.5. Cable Division: The Cable Television Division of the Massachusetts <br /> Department of Telecommunications and Cable. <br /> 1.6. Cable Service or Cable Services: Shall be defined herein as it is defined <br /> under Section 602(6) of the Communications Act, 47 U.S.C. § 522(6), meaning the one-way <br /> transmission to Subscribers of Video Programming or other programming service, and <br /> Subscriber interaction, if any, which is required for the selection or use of such Video <br /> Programming or other programming service. <br /> 1.7. Cable System or System: Shall be defined herein as it is defined under <br /> Section 602(7) of the Communications Act, 47 U.S.C. § 522(7), meaning a facility, consisting of <br /> a set of closed transmission paths and associated signal generation,reception,and control equipment <br /> that is designed to provide cable service which includes video programming and which is provided <br /> to multiple Subscribers within the Town, but such term does not include (A) a facility that serves <br /> only to retransmit the television signals of one or more television broadcast stations; (B) a <br /> facility that serves subscribers without using any public right-of-way; (C) a facility of a common <br /> carrier which is subject, in whole or in part, to the provisions of Title II of the Communications <br /> Act, except that such facility shall be considered a cable system (other than for purposes of <br /> section 621(c) of the Communications Act) to the extent such facility is used in the transmission <br /> of video programming directly to subscribers unless the extent of such use is solely to provide <br /> interactive on-demand services; (D) an open video system that complies with Section 653 of the <br /> Communications Act; or (E) any facilities of any electric utility used solely for operating its <br /> electric utility systems. <br /> 1.8. Channel: Shall be defined herein as it is defined under Section 602(4) of <br /> the Communications Act, 47 U.S.C. § 522(4). <br /> 1.9. CMR: The Code of Massachusetts Regulations. <br /> 2 <br />
