Minutes of November 18, 2021 were approved. Forestry Department Updates 1. A. Fall tree planting is 60% complete. Lack of frost will allow the remaining trees to be planted in the next two weeks. B. A discussion of the specific tree species planted this fall including Japanese Lilac, Red Maple and male Ginkgo resulted in the consensus conclusion that a review and update of the existing approved tree list is required. 2. The Tree Inventory Study continues with DPW staff software training and public access to the study targeted in 1 to 2 months. 3. No change/update to the Tree Canopy Assessment. 4. A proposal for the replacement trees in the Battle Green will go forward to the Select Board in February. Pending SB approval planting will occur after Patriots Day. 5. Article 33 implementation on Viewpoint Cloud requires initial coordination with town's IT Director. Dave P. committed to providing a proposed updated spreadsheet format to the committee by early January. 6. 135 Worthen Rd. Project was reviewed with respect to the "look back"provision of the Tree Bylaw and how to deal with and monitor delayed development and early removal of setback trees. Dave P. Will talk to building inspector regarding compliance, enforcement and building permit delays. A general discussion occurred with respect to possible modifications/enhancements of the Tree Bylaw to better capture"look back"conditions including: A. Increased pre-permit coverage from one year to two years. B. Increased fees for late retroactive application amendments. 7. The January 6 Hearing for 30 Ingleside Road regarding the removal of the "Tree of Heaven" trees in the Town right of way was discussed and determined that the Tree Committee is in favor of identifying particular, harmful, non-native, invasive tree species for removal and exempting them from the calculations in the Tree Bylaw on a case by case basis and without establishing a broad, wide ranging precedence. 8. Applicability of Bylaw. Dave P. and Town Counsel confirmed that unaccepted streets are on private property and are not considered town owned land. Therefore, the Bylaw only applies to setback requirements on these private lots. 9. Applicability of Bylaw Part 2. The Bowman School tree removals was the other topic of discussion with regards to the Bylaw. It was determined that 1. The Conservation Department has town jurisdiction not the DPW. 2. No town permission was granted for Eversource to remove the trees. 3. A potential fee of$50,000 - $100,000 for the removal of the trees is possible. 4. Continued conversations are occurring between the Town and Eversource to resolve the matter. 10. Mark Sandeen initiated a discussion on new sidewalk construction on Lincoln and Cedar Streets. Significant tree removal is slated for both sites with as much as 120 inches removed on Cedar Street. Gerry P., Mark S., Nancy S. and Gloria B. agreed to walk the sites and to determine if a possible solution exists to minimize tree loss while maintaining public safety. 11. Marty Kvaal monitored Planning Board meetings with regard to tree coverage impacts and issues. She brought to the Committees attention the 12 Summit Rd. development. 12. Nancy Sofen is in the process of establishing a working relationship with the Town's Permanent Building Committee as the Tree committee's liaison. The initial goal is to create a presentation (see attached) to the PBC of the Tree Committee's general objectives with regards to Town funded building projects.
