March 24, 2021 Adjourned Session of the 2021 Annual Town Meeting cont'd... <br /> ARTICLE 25: AMEND BORROWING AUTHORIZATION CONSERVATION <br /> LAND ACQUISITION <br /> MOTION: That the Town vote to amend the source of funding and borrowing authorization for <br /> the acquisition of conservation land at 39 Highland Avenue, approved under Article 7 of Special <br /> Town Meeting 2020-3, by (1) increasing the $1,680,000 appropriated from the Undesignated <br /> Fund Balance of the Community Preservation Fund by $1,000,000, for a total of$2,680,000 to <br /> be appropriated from the Undesignated Fund Balance of the Community Preservation Fund for <br /> the purposes of said acquisition and any costs incidental thereto; and (2) rescinding the <br /> borrowing authorization voted under Article 7 of Special Town Meeting 2020-3 and reducing the <br /> amount authorized to be borrowed thereunder to $0. <br /> ARTICLE 27: INCREASE IN RECREATION COMMITTEE MEMBERSHIP <br /> MOTION: That § 29-17 of the Committee Bylaw, Chapter 29 of the Code of the Town of <br /> Lexington, be amended by replacing the word "five" with the word "seven" in the second <br /> sentence thereof, thereby increasing the membership of the Recreation Committee from five to <br /> seven members. <br /> ARTICLE 28: REDUCING NOISE FROM LANDSCAPING EQUIPMENT <br /> MOTION: That this article be indefinitely postponed. <br /> ARTICLE 37: AMEND GENERAL BYLAW STORMWATER MANAGEMENT <br /> (CHAPTER 114) <br /> MOTION: That §114-4.A(3)(a) of the Stormwater Management Bylaw, Chapter 114 of the <br /> Code of the Town of Lexington, be amended as follows, where struck though text is to be <br /> removed: <br /> Requires a special permit or a special permit with site plan review. <br /> ARTICLE 38: AMEND GENERAL BYLAWS-TREES (CHAPTER 120) <br /> MOTION: That this article be indefinitely postponed. <br /> ARTICLE 40: AMEND ZONING BYLAW-RETAINING WALLS <br /> MOTION: That this article be indefinitely postponed. <br /> ARTICLE 42: AMEND ZONING BYLAW—FLOODPLAIN MANAGEMENT <br /> MOTION: That the Zoning Bylaw, Chapter 135 of the Code of the Town of Lexington, be <br /> amended by adding the following §135-7.1.7: <br /> 7.1.7 Floodplain Administrator. <br /> The Town Manager or their designee shall serve as the official Floodplain Administrator for the <br /> Town of Lexington. <br /> ARTICLE 43: AMEND ZONING BYLAW- TECHNICAL CORRECTIONS <br /> MOTION: That this article be indefinitely postponed. <br /> 10:06 p.m. There were several questions from members on the Consent Agenda, including <br /> the cost of chrome books for the High School, why HVAC Improvements in the schools were <br /> Indefinitely Postponed, a procedural question regarding Article 25, Park and Playground <br /> funding, and why Technical Corrections to the Zoning Bylaw were Indefinitely Postponed. <br /> 10:14 p.m. The Moderator called the vote, explaining that a two-thirds vote would be needed <br /> for passage of the Consent Agenda. <br /> 10:16 p.m. Following remote electronic vote tallying, the Moderator declared the CONSENT <br /> AGENDA Adopted by the necessary two-thirds on a vote of: <br /> Yes No Abstain <br /> 179 0 3 <br /> 10:18 p.m. The Moderator reviewed the schedule for the upcoming session of Annual Town <br /> Meeting. <br />
