BOA Meeting September 11, 2014 <br />18 <br />One of the Board members asked when the proposed sidewalk is completed will the <br />trees blocking the view of the signs be removed; if so, will sign be taken down. (No, <br />the trees effecting the view are on Swommon land.) <br />A Board member asked Attorney Grant to explain the Planning Board’s concern with <br />the Development Standards. <br />Other Board member questioned the involvement of abutters in meetings concerning <br />the Development and if the screening for the direct abutters had been settled. (Mr. <br />Hicks answered they have made improvements to landscaping to address abutters <br />concerns and they are pleased with the changes.) <br />Jim Joyce of 5 Stonewall Road would like to have his name added to the list of people <br />that notified of any neighborhood meetings. Mr. Hicks took his name and address <br />down. <br />There were no questions from the audience. <br />Steven Heinrich of 11 Potter Pond Road, a town meeting member, spoke in support of <br />the project. <br />No one spoke in opposition to the petition. <br />The Chairwoman closed the hearing at 9:50 pm. <br />The Board discussed the waivers and relief they were requesting. <br />On a motion by Jeanne K. Krieger and seconded by Edward D. McCarthy, the Board <br />voted 5-0 grant the following zoning relief in accordance with the listed sections of the <br />Bylaw: <br />1. Approval of the DSDUP (including revisions made to the plan pursuant to 135- <br />7.3.5.6.d) as confroming substantailly to the PSDUP approved by Town Meeting <br />and consistent with the considerations set forth in Bylaw §§ 135-9.4.2 and § 135- <br />7.3.5.6.a <br />And, on a motion by Leo P. McSweeney and seconded by Jeanne K. Krieger, the <br />Board voted 5-0 grant the following zoning relief in accordance with the listed sections <br />of the Bylaw: <br />2. A SP for certain new uses, and other site improvements, pursuant to § 135- <br />7.3.5.6, § 135-9.4.2, and the PSDUP approved for the Site by a vote of Town <br />Meeting on June 16, 2014 subject to the following condtions: <br />The above listed zoning relief is subject to the following conditions: <br />a. This project shall comply with the terms and conditions of the executed <br />Memorandum of Understanding between the Town of Lexington and Artis <br /> <br />
