<br /> <br />Minutes of the Lexington Zoning Board of Appeals <br />Selectmen’s Meeting Room <br />November 14, 2013 <br /> <br /> <br />Board Members Present: Chairman – Martha C. Wood, Jeanne K. Krieger, Edward D. <br />McCarthy, Leo P. McSweeney and David G. Williams <br /> <br />Also present at this hearing were Associate Members: Ralph D. Clifford, Nancy M. <br />Adler and Richard A. Michelson. <br /> <br />Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning <br />Administrator <br /> <br />Address: 6 Hudson Road, Map 25, Lot 223 <br /> <br />The petitioner submitted the following information with the applications: nature and <br />justification of request; a topographic plan; a plot plan; shed specifications and a <br />request for a waiver from the certified plot plan. <br /> <br />Prior to the hearing, the petitions and supporting data were reviewed by the Acting <br />Building Commissioner, Conservation Administrator, Town Engineer, Board of <br />Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts <br />Commission Clerk. Comments were received from the Zoning Administrator. <br /> <br />The Chairman opened the hearings by reading the legal notices and described <br />information received from the petitioner. <br /> <br />SPECIAL PERMIT <br />The petitioner is requesting a in accordance with the Zoning By- <br />Law (Chapter 135 of the Code of Lexington) section 135-8.4.2 and section 135-9.4.2 <br />to allow an increase in a nonconforming nature. <br /> <br />Christopher Anderson, owner of the property, presented the petition. <br /> <br />A Board member asked why they need the shed, why not use their garage. (The <br />applicant responded with 3 boys they have a lot of toys, equipment, etc.) <br /> <br />A member thought the applicant had a clear case for needing a shed, her question <br />was directed to the Zoning Administrator. Could the Board condition the special permit <br />to the current owner only? <br /> <br />There were numerous questions from the Board as to where the shed could be located <br />on the property and for storning alternatives other than a shed. There was concern <br />with the shed being placed close to the abutter’s property and being intrusive as you <br />come down Munroe Street. <br /> <br />Mark Duffy of 46 Spring Street asked the Board to explain what non-conforming meant <br />and how did it relate to the shed. <br /> <br /> <br />
