Minutes of the Lexington Zoning Board of Appeals Selectmen’s Meeting Room June 27, 2013 Board Members Present: Chairman – Carolyn C. Wilson, Jeanne K. Krieger, Leo P. McSweeney, David G. Williams and Associate Member Ralph D. Clifford Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Address: 36 Moon Hill Road, Map 8, Lot 26 The petitioner submitted the following information with the application: nature and justification of request; topographic plan; plot plan; garage plans; elevations; Ma Cultural Resource Information; quit claim deed and a copy of the BOA decision dated March 10, 1955 Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts Commission Clerk. Comments were received from the Building Commissioner and the Zoning Administrator. Architects Jessica Gann and Art Swartz of Black River Architects presented the application for the owners of the property, Susan Greenhailgh explaining the proposed new 2-car garage. The petitioner is requesting a VARIANCE in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section 135-4.4., Table 2, Schedule of Dimensional Controls to allow a side yard setback of 5 ft. instead of the required 15 ft. Mr. Swartz presented letters of support from Dr. Steve Varga-Golovcsenko of 38 Moon Hill Road and Barbara Katzenberg and Peter Piela of 37 Moon Hill Road and a letter of support from the neighborhood design group. There were no questions from the audience No one spoke in favor or in opposition to this petition. The hearing was closed at 7:38 pm. On a motion by Leo P. McSweeney and seconded by Jeanne K. Krieger, the Board voted 5-0 to approve a variance in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section 135-4.4., Table 2, Schedule of Dimensional Controls to allow a side yard setback of 5 ft. instead of the required 15 ft.
