BOA Meeting May 23, 2013 4 <br />Minutes of the Lexington Zoning Board of Appeals <br />Selectmen’s Meeting Room <br />May 23, 2013 <br /> <br />Board Members Present: Chairman – Carolyn C. Wilson, Jeanne K. Krieger, Leo P. <br />McSweeney, Martha C. Wood and Associate Member Richard A. Michelson <br /> <br />Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator <br /> <br />Address: 25 Hayward Avenue, Map 48, Lot 19 <br /> <br />The petitioner submitted the following information with the application: nature and justification <br />of request; a topographic plan, floor plans, letters of support from 2 abutters and a drainage <br />analysis. <br /> <br />Prior to the hearing, the petition and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning <br />Administrator, the Planning Director and the Historic Districts Commission Clerk. Comments <br />were received from the Building Commissioner, the Conservation Administrator and the <br />Zoning Administrator. <br /> <br />The Chairman opened the hearing at 8:15 pm by reading the legal notice and described <br />information received from the petitioner. <br /> <br />The applicant is requesting variance from section 135-5.1.11 to allow a 0 ft. side yard setback <br />for a drive way instead of the required 5 ft and a special permit from section 135-8.4.2 to allow <br />an increase in a nonconforming nature of a residentail structure. <br /> <br />Barney Maier, architect for the proposed project, presented the petition for the owners of the <br />property, Timothy and Shannon Kreytak. <br /> <br />A Board member asked what was the present square footage of the property and if the house <br />would have gutters. <br /> <br />There were no audience questions. <br /> <br />No one spoke in favor or in opposition to the petition. <br /> <br />The hearing was closed at 8:26 pm. <br /> <br />On a motion by Jeanne K. Krieger and seconded by Richard A. Michelson, the Board voted 5- <br />0 to approve a variance from section 135-5.1.11 to allow a 0 ft. side yard setback for a drive <br />way instead of the required 5 ft and aprroved a special permit from section 135-8.4.2 to allow <br />an increase in a nonconforming nature of a residentail structure with the condition the <br />applicant shall install an infiltration system. <br /> <br /> <br /> <br /> <br /> <br /> <br />Submitted by: Dianne Cornaro, Administrative Clerk <br /> <br /> <br /> <br /> <br />
