Minutes of the Lexington Zoning Board of Appeals Selectmen’s Meeting Room April 25, 2013 Board Members Present: Chairman – Carolyn C. Wilson, Jeanne K. Krieger, David G. Williams, Martha C. Wood and Associate member William P. Kennedy Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Address: 1752 Massachusetts Avenue, Map 49, Lot 35A The petitioner submitted the following information with the application: nature and justification of request; floor plans, decision from May 11, 2006 and a waiver for the certified plot plan. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director, Economic Development and the Historic Districts Commission Clerk. Comments were received from the Zoning Administrator. The Chairman opened the hearing at 7:30 pm by reading the legal notice and described information received from the petitioner. The applicant is requesting 2 SPECIAL PERMITS in accordance with the Zoning By- Law (Chapter 135 of the Code of Lexington) to allow: 1. Modification of the parking requirements per section 135-5.1.14 and 2. A fast food use per section 135-3.1.1, Table 1: Schedule of Permitted Uses and Development Standards, Line J.1.02. Joe Rancatore, owner of the busiiness, presented the petition. At the hearing Mr. Rancatore gave a brief history of the business and requested a special permit for a period of five years. Board members asked if there were any changes being made to the business and if the the hours of operation would be changed. (No to both questions.) There were no questions from the audience. No one spoke in favor or in opposition to the petition. The hearing was closed at 7:34 pm. On a motion by Jeanne K. Krieger and seconded by William P. Kennedy, the Board voted 5-0 to waive the certified plot plan requirement. On a motion by Jeanne K. Krieger and seconded by William P. Kennedy, the Board voted 5-0 grant a SPECIAL PERMITModification of the parking requirements per section 135-5.1.14.
