<br />Minutes of the Lexington Zoning Board of Appeals <br />Selectmen’s Meeting Room <br />April 25, 2013 <br /> <br />Board Members Present: Chairman – Carolyn C. Wilson, Jeanne K. Krieger, David G. <br />Williams, Martha C. Wood and Associate member William P. Kennedy <br /> <br />Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning <br />Administrator <br /> <br />Address: 1752 Massachusetts Avenue, Map 49, Lot 35A <br /> <br />The petitioner submitted the following information with the application: nature and <br />justification of request; floor plans, decision from May 11, 2006 and a waiver for the <br />certified plot plan. <br /> <br />Prior to the hearing, the petition and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the <br />Zoning Administrator, the Planning Director, Economic Development and the Historic <br />Districts Commission Clerk. Comments were received from the Zoning Administrator. <br /> <br />The Chairman opened the hearing at 7:30 pm by reading the legal notice and <br />described information received from the petitioner. <br /> <br />The applicant is requesting 2 SPECIAL PERMITS in accordance with the Zoning By- <br />Law (Chapter 135 of the Code of Lexington) to allow: 1. Modification of the parking <br />requirements per section 135-5.1.14 and 2. A fast food use per section 135-3.1.1, <br />Table 1: Schedule of Permitted Uses and Development Standards, Line J.1.02. <br /> <br />Joe Rancatore, owner of the busiiness, presented the petition. <br /> <br />At the hearing Mr. Rancatore gave a brief history of the business and requested a <br />special permit for a period of five years. <br /> <br />Board members asked if there were any changes being made to the business and if <br />the the hours of operation would be changed. (No to both questions.) <br /> <br />There were no questions from the audience. <br /> <br />No one spoke in favor or in opposition to the petition. <br /> <br />The hearing was closed at 7:34 pm. <br /> <br />On a motion by Jeanne K. Krieger and seconded by William P. Kennedy, the Board <br />voted 5-0 to waive the certified plot plan requirement. <br /> <br />On a motion by Jeanne K. Krieger and seconded by William P. Kennedy, the Board <br /> <br />voted 5-0 grant a SPECIAL PERMITModification of the parking requirements per <br />section 135-5.1.14. <br /> <br /> <br /> <br />
