Minutes of the Lexington Zoning Board of Appeals Selectmen's Meeting Room, Lexington Town Hall January 24, 2008 Board Members Present: Chairman — Arthur C. Smith, John J. McWeeney, Judith J. Uhrig, Carolyn C. Wilson and Associate Jill I. Hai Staff present: Garry Rhodes, Building Commissioner, David George, Zoning Administrator and Dianne Cornaro, Administrative Clerk. Petition Address: 45 Hartwell Avenue, Lot and Map: 008500018A The relief sought is for zoning relief in accordance with the following provisions of the Zoning By -law (Ch. 135 of the Code of the Town of Lexington): two SPECIAL PERMITS: 1) per section 135 -75A to allow an internally illuminated sign; and 2) per section 135- 77(A)(3) in conjunction with section 135 -78 to allow a standing sign The Chairman opened the hearing at 7:30 PM by reading the legal notices and described information received from the petitioner relative to the petitions. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Health Agent, Board of Selectmen, Zoning Administrator, Planning Board, the Historic District Commission and the Design Advisory Committee. Comments were received from the Building Commissioner, the Zoning Administrator and the Design Advisory Committee. Stephen Duffy, representing Duffy Properties, presented the petition. The Board had questions regarding the illumination and the placement of the sign on the lot. There were no questions from the audience. No one spoke in favor of the petition. No one spoke in opposition of the petition. The Chairman closed the hearing at 7:38 pm. On a motion by Jill I. Hai and seconded by John J. McWeeney, the Board voted 5 -0, to approve two special permits: 1) per section 135 -75A to allow an internally illuminated sign; and 2) per section 135- 77(A)(3) in conjunction with section 135 -78 to allow a standing sign.
