January 10, 2008 ZBA Minutes 6 During the hearing final discussion the Board had no problem with the request and felt that the special permit met the by -law requirements, and that due to the shape of the lot the variance should be granted. The hearing closed at 8:04 pm. On a motion by John J. McWeeney and seconded by Carolyn C. Wilson, the Board voted 5 -0, to approve the variance for a side yard set back of 8.4 feet instead of the required 20 -foot side yard setback at 38 Charles Street. On a motion by John J. McWeeney and seconded by Nyles N. Barnert, the Board voted 5 -0 to approve the special permit to demolish and reconstruct the front stairs at 38 Charles Street. On a motion by John J. McWeeney and seconded by Nyles N. Barnert, the Board voted 5 -0 to approve the special permit to demolish and reconstruct the deck at 38 Charles Street.
