Minutes of the Lexington Zoning Board of Appeals — January 13, 2005 Present: Acting Chair,. Arthur Smith, Nyles Barnert, Maura Sheehan, John McWeeney and Associate John Gilbert sitting in for Judith Uhrig. Petition Address: 18 Hickory Street The Chairman opened the hearing at 7:45 PM by reading the legal notice and described information received from the Petitioner, other Boards and Commissions relative to the Petition. There were 5 letters of support submitted with the petition. Subhash C. Gupta, owner of the property, presented the Petition. The relief sought is for a Variance in accordance with Zoning By -law section 135 -35 to allow relief from front and side set backs. The hardship is with the placement of the house on the lot a variance is needed for proposed additions. Questions from the Board: Mrs. Sheehan: Are there wetlands in the back? Answer: Not usually any standing water. A little wet right now with weather as it's been. Questions from the audience: None Speakers in favor — Mr. Ron Gold, abutter was present and in favor of the project saying that he would be the neighbor most effected by project. He thought that Mr. Gupta's addition would be very tasteful and would be an enhancement to neighborhood. Speakers opposed: None Hearing was closed at: 7:53 pm Decision: On a Motion by Mr. Nyles Barnert and seconded by Mr. John Gilbert, the Board by vote of 5- 0, granted the variance to allow a 24'6" front setback and a 10' /z foot side setback at 18 Hickory Street.
