4 <br /> DRAFT MINUTES of the Lexington Zoning Board of Appeals August 11, 2005 <br /> Present: Chairman Judith J. Uhrig, Arthur C. Smith, Nyles N. Barnert, Maura L. Sheehan and John J. <br /> McWeeney <br /> Petition Address: 30 Greenwood Street <br /> The Chairman opened the hearing at 7:58 pm by reading the legal notice and described information <br /> received from the Petitioner relative to the Petition. No comments from any Board or Commission were <br /> received. <br /> James and Constance Cooper, owners of the property, presented the petition along with a petition of <br /> support signed by 10 abutters and photographs of their home and homes in the neighborhood. <br /> The relief sought is to allow a variance from front set back requirements as defined in Section 135 -35, <br /> Table 2, Dimensional Controls of the Lexington By -Laws. <br /> Questions from the Board: <br /> Arthur Smith: Do you need a variance for the plans on the back? Answer: No because my frontage is <br /> less than 100 feet I only need 12 -foot variance. <br /> Maura Sheehan: Asked to verify which house was theirs. <br /> Nyles Barnert: Shed is non - conforming. Answer: Yes, it is coming down. <br /> Judy Uhrig: What did you mean by the topography of the front, didn't think the grade was an issue on <br /> the front. Answer: In order to be able to have enough room to get on the porch they need to raise the <br /> grade in the front. The porch is actually 1 -foot less non - conforming then the stairs were. <br /> There were no questions from the audience. <br /> No one spoke in favor of the petition. <br /> No one spoke in opposition. <br /> The hearing was closed at 8:09 pm. <br /> On a motion by Arthur Smith and seconded by Nyles Barnert, the Board voted 5 -0 to APPROVE the <br /> variance for a front setback of 27.82 feet. <br /> Submitted by Dianne Cornaro, Clerk <br />
