Minutes of the Lexington Zoning Board of Appeals July 27, 2006 <br /> Present: Chairman — Judith J. Uhrig, Nyles Barnert, Maura Sheehan, Arthur Smith and <br /> Associate Leo McSweeney <br /> Petition Address: 35 Bernard Street <br /> The relief sought is for a Variance from Section 135 -35, Table 2, Dimensional Control to allow a <br /> front set back of 26.1 -feet instead of the required 30 -feet to change the configuration of the front <br /> stairs. <br /> The Chairman opened the hearing at 7:45 PM by reading the legal notice and described <br /> information received from the petitioner relative to the petition. <br /> Prior to the hearing, the petition and supporting data were reviewed by the Building <br /> Commissioner, Conservation Administrator, Town Engineer, Health Director, Zoning <br /> Enforcement Officer, Planning Board and Selectmen's Office. Comments were received from <br /> the Conservation Administrator letting the applicant know they needed to file with the <br /> Conservation Commission regarding this project. <br /> Xiaojin Xiong, owner of the property, presented the petition. <br /> The Board had questions regarding the hardship and the legality of the shed in the backyard. The <br /> petitioner explained the shed was there when they bought the property and will check the <br /> dimensions and set back. <br /> There were no questions from the audience. <br /> No one spoke in favor or in opposition of the petition. <br /> Hearing was closed at 7:56 <br /> Discussion: The majority of the board felt the project was consistent with the neighborhood and <br /> the hardship was clear because the house had to be built forward towards the street because of <br /> the wetlands in the rear of the lot. <br /> On a motion by Nyles Barnert and seconded by Leo McSweeney the board voted 5 -0 to GRANT <br /> the VARIANCE to allow a front set back of 26.1 -feet instead of the required 30 -feet to change <br /> the configuration of the front stairs. <br />
